UKPS Parking Charge - unsure what to do next

Seems to me you need to find out from the restaurant who owns/leases the land that they say is customer parking. You need to find out where the demarkation is between left and right hand sides.
Do the pictures show the menu in the windscreen?
Were they taken when you parked on the left or right hand side?
Obviously your 3 minute absence was in going to check the signs and verify where you could park - the Grace period -so if you were photographed then, that's your defence if photographed on the "wrong side".0 -
Photos were taken in the time while it was on the 'wrong side'. So before the menu was on the dash.
And obviously due to the fact that there was nothing to indicate fine stuck to the windscreen on return to the car timed photos could not be taken to prove that the car was moved to the 'right side' literally 3 minutes after the pictures were taken.0 -

Just received another letter from Zenith Collections with 'Notice to Commence Legal Proceedings' at the top. I go away in 2 days so am going to send the IPC template letter to UKPS today. Should I contact Zenith Collections at all?0

You have already been advised what to do about debt collectors. The information in the NEWBIES thread is quite specific about this.

Zenith Collections is Debt recovery Plus if you look at the letter I think you will find it tells you that at the bottom, it's just another desperate attempt at frightening you with another letter heading.
They cannot start legal proceedings, and if the PPC does the debt recovery Muppets fall off the scene, get zilch, and the charge goes back to the original cost.
So ignore debt collectors!!!!0 -
Just received a response back from the IPC template appeal that I sent them yesterday. Not sure what to do next. I saw on the newbies thread some suggestions of sending something to the debt recovery people to deny the debt. Or is there a draft that I can send back to this directly to UKPS to further appeal?
Dear Ms Torley,
Thank you for your recent communication concerning the above Parking Charge. Please rest assured that our Appeals Manager has personally reviewed this case and carefully considered the various points raised. Their view, however, is that the Parking Charge is neither unreasonable nor unjust and so we will not be waiving this parking charge.
To be honest if i had been issued a parking fine, i would look on the internet for help, there are numerous site that have help letters which you cut and paste into a letter or email and you think these are helping you. In fact they are making the matter a lot worse for the motorist, who have belief and are given hope that these letters will save the day unfortunately they will not, and only escalate the original Parking Charge Notice.
Once we have set out the first notice and the reminder notice, you have 21 days to appeal which was long ago. This has been past to Debt Recovery Plus now, so you will have to contact them.
Please be aware that the vehicle was parked in a PERMIT HOLDERS ONLY CAR PARK, this car park is for business users that have premise at the Walsgrave road which this car park is behind. It is not for the general public to use, when you used the car park you deprived a permit holder of his parking Space. UKPS Ltd have worked this site since October 2016, it became necessary to monitor the site as it was just a free for all and the landowner was getting complaints of permit holders which had paid for their permit but was unable to use.
The contract that UKPS Limited has with the owner or occupier of the land (which authorises UKPS Limited to enter into a contract with the driver requiring the payment of Parking Charges in respect of parking of the vehicle on the land) contains a confidentially clause and as such we are not in a position to provide the contract to you.
As a member of the Approved Operator Scheme, UKPS Limited are audited by the IPC to ensure that we have all relevant contracts in place. UKPS Limited will provide the court with a copy of this in full if they require it, or can provide a written statement to this effect from those party to the contract. We are also more than happy to provide confirmation to the independent assessors that we are authorised to manage parking at this site. We can confirm that parking management at this site has been contracted to UKPS Limited.
All of our signage is fully compliant with the guidelines set our within the IPC Code of Practice and we reject the notion that it is in any way unclear or ambiguous.
The highest court in the UK, the Supreme Court, has unambiguously confirmed that parking charges issued on private land are fully enforceable. In the case of ParkingEye v Beavis (2015) UKSC 67 their Lordships stated that private parking charges were enforceable because they served a legitimate interest and were in the interests of the public generally. The case confirmed that the amount of the charge does not have to reflect any loss that might have been caused by breach of the terms and conditions of parking.
The Supreme Court decision is binding law on all other courts throughout the UK.

We appreciate that this is not the outcome you will have hoped for. Unless you have any additional information that you have not already brought to our attention this decision is final.
In light of the contents of this letter you now have a number of options:
1. Pay the parking charge detailed above at the reduced rate of £65; to UKPS Limited. PLEASE REFER OVERLEAF FOR PAYMENT OPTIONS AND ADDRESS DETAILS.
2. If you are not happy with our decision you can contact the IAS xxx.theias.org standard Appeals service within 21 days of this appeal being declined.
By law we are also required to inform you that the Ombudsman Services xxx.ombudsman-services.org provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to IAS, as explained above.
3. If you choose to do nothing the parking charge will automatically increase after 35 days from the date of this letter to £100 and the matter will be passed to our debt recovery agent, at which point you will be liable to pay an additional charge of £50, in accordance with our terms and conditions of parking and further charges will be claimed if Court action is taken against you. Any unpaid Court Judgement may adversely affect your credit rating.
PLEASE DO NOT IGNORE THIS LETTER, UKPS LIMITED REGULARLY TAKES MOTORIST TO COURT WHO IGNORE THEIR PARKING CHARGES.

As Redx said on another IPC thread, if you are looking for a "magic bullet", an easy solution, there isnt one unless you can get a written cancellation from the PPC after complaining to the landholder (this is ALWAYS the best solution anyway).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
