Argos complaint - tablet with cracked screen

    Just to update everyone, I complaint to Argos head office and they were patient in hearing and refunded the amount I paid for the tablet. I had to send it to their head office but very happy that people at higher level still take care of small customers and listen to them.

    Here is a very black and white way of looking at your case from the store's point of view. One of the nice things about buying a new item like a smartphone, tablet, PC etc is that when you first switch it on you will be presented with a 'welcome' screen that will want to walk you through a set up procedure - such as choosing your language, keyboard layout, wifi connection, etc. This rather loudly shouts 'I am new and I have not been messed with, ever'. If the tablet was damaged from new then given what you've said about the touchscreen not working from the very start, your tablet will of course still be in it's default 'welcome' state. It will therefore be easy to prove to anyone who is reasonable that you could not have possibly broken it (unless it was dropped the moment you took it out of the box!). Yes, it is possible to reset such devices back to their 'new' state, although this would not be easy with a broken interface. If however, the tablet has moved on from the 'welcome' screen, then I would say it all looks a bit suspicious to anyone from the store viewing your tablet. The only way you could have moved on from the 'welcome' screen is by interacting with it using the touchscreen. While my logic does not provide 100% concrete evidence either way - I suspect it is the closest your are going to get to a reasoned argument the puts the probability firm in your favour or the store's favour.

    Isn't that exactly what Fosterdog posted a month ago in post #19?

    I have just received a full refund for a cracked screen from Nationwide Visa - but I had to make an on line Small Claims because Nationwide totally ignored the Sale of Goods Act and Section 75 - they just say NO and hope you will just give up ........ well don't! Know your rights and insist you get your rights!!

    If you knew your rights you wouldn't be quoting SOGA - it was replaced 3 years ago.

    The OP of this thread did not have to approach his bank in this case because Argos refunded way back in March 2017.
