OP ... Amex is a charge card rather than a credit card so I don't think you'd have Section 75 protection.
Amex do also offer credit cards.
OP, if your card is a credit card then you should have a read of MSE's Section 75 article before considering court action.0 -

No I cant because the main reason of buying from a reputed company like Argos is that I will have the peace of mind for after sales service. But at the same time, how can they say it is a accidental damage? They have not even got it checked by their technical support. But is not the case with all faulty items - as soon as we are out of the shop, anything can happen - then how do they agree for a replacement? I do agree the number of days and for that I have provided the reason. Thank you, I have a amex platinum card so if it doesnt go to any further level with Argos I will try section 75 option.OP naively thought Argos would be selling goods that would be as described and of reasonable quality. As OP bought it as a gift then OP didn't think it necessary to open it all up and inspect it. No doubt OP will remember to do so in future ... however your comment provides no help whatsoever to OP's current situation.

Regardless, within 6 months of purchase then any fault is presumed to be inherent and the seller must prove otherwise. (Simply saying so isn't proof). You could send them a Letter Before Action (templates all of the Internet) that advises Argos that you'll seek a remedy through the County Court (small claims) if they don't deal with your complaint (provide a repair, replacement or full refund).0 -

Bottom line is they see a broken screen and it's been dropped simple as that.0 -
If the touch screen is not working because of the crack then it will be easy to show that the tablet has never been used, as soon as you turn it on it will be at the initial set up screen. If you (or the gift recipient) had cracked it then the chances are it would have been either during or after setup so it will be further along the setup process or even fully set up which again would be obvious if the screen no longer works.0
