Sofa on finance in my name, Sofa currently in ex girlfriends house.

Hi all
When me and my ex partner moved in to our first rented accommodation I bought a sofa from DFS on buy now pay later. We were to pay half each of the monthly payments!
Six months later due to work reasons we gave up the house and I moved back to London (she lived in swansea) and we continued our relationship long distance.
We decided that her parents would have the sofa until we were able to move into our own accommodation again and we would continue to pay the monthly payments.
After our first payment was due we broke up and now I am left paying the monthly payments on my own.
I have contacted her parents and asked if they would prefer to keep the sofa and pay me the remaining that's due on it or if they would rather I take it back.
Do I have any legal standings with this or am I just going to have to continue paying it?. I have the original finance agreement and reciept which is all in my name.

If it's all in your name, you are legally responsible for paying it unfortunately. I would however be collecting it!

It clearly belongs to you, it doesn't sound like it was ever given as a gift to the parents just that they would physically hold on to it until you could take it back from them.
If they say they will take over the payments, would you be happy with that? If they make them direct to you then you'll know if they stop and can collect it in that event.0 -

What I was asking is am I within my rights to go and collect without being arrested for theft because it's in their house. Obviously I wouldn't break into the property lol
I wouldn't accept monthly payments....they would have to pay me the remaining balance up front as I would rather just be done with it than have the next for months watching and waiting for payments.
No This wasn't given as a gift. It was more so we wasn't wasting money on storage and also they needed a sofa and it was agreed they could just use ours (MINE) until we planned to get our own accommodation again.
I spoke to her father and gave him the two options of pay me for it or I'll have it back...he said he will ask what the wife wants to do. But I've been waiting for a reply for a week now!

Is it an expensive sofa? If you have to hire a van and pay fuel from London to Swansea it might not be worth the hassle.0

I'd give him a reminder and tell him you want to know what they want to do about the sofa because you want to get this sorted by x date - i.e. give him a deadline.
Are they storing the sofa or using it?
If they're using it, maybe they've been looking round for a replacement before telling you you can have it back.0 -
Hi I'm going through same thing I was about to move in with a women I bought new wardrobes on my credit cards new beds on finance two weeks ago then I got a call to say she dident want to be with me she has blocked me on everything I want my goods back as I've only paid two payments so going to see a solicitor tomorrow surely I have rights she won't pay and there on finance she won't answer my calls won't open the door to me I need to no were I stand wot was ur outcome0

As the sofa is technically second hand they would have to be mad or incredibly generous to pay you the balance. Come to an agreement of a one off payment for an agreeable and reduced amount (as is second hand) or collect it ... Whichever option you will still have to pay the balance0
