CEDR adjudicator in our favour but No payment

Can anyone help as I just don't know what to do! I complained to Thomson as we had over a 4 hour flight delay from Manchester airport to Jamaica in August 2016. Thomsons only reply was a cheque for half of the money claimed. I went through CEDR who basically sent the case to an adjudicator. The decision went in our favour for the full amount and Thompson were ordered to pay us by the 7th Feb 2017. I have never banked the cheque originally sent from Thomson as this would be deemed as acceptance and case closed.

Since that date I have contacted CEDR who are able to keep chasing it up with Thomson but have said there is no date as to when we will receive payment as all they can do is chase - Thomson may just keep ignoring them - my only option is to take them to court.

I have never done anything like this before and I really can't afford a court costs - I have the CEDR adjudicator report - would this mean that I would definitely win and would it be a good idea???

    If the time limit for payment has passed you should contact CEDR and also the CAA to let them know that Thomson have failed to comply with the decision. If a clear pattern of non-compliance emerges ( and we have seen many cases similar to yours) CEDR can expel Thomson from the scheme and the CAA can take action.
    The point of this is to show non compliance on a wide scale, not so much to help you but others.
    CEDR have no powers of enforcement of their own but the rules of the scheme state that their decision is binding on the airline so if you were to sue Thomson it would be to enforce that award.
    The simple fact is that Thomson have never engaged sufficient staff to deal with these cases.

    I am also waiting for a payment due by 14th Feb, I have emailed and spoken to CEDR and they will keep chasing until they pay, the lady I spoke to said it is just the amount of cases that they are dealing with and they will definitely pay, they seem to send a list of payments due over to Thomson's about 3 times a week and the list gets updated all the time with those that have been paid getting removed and of course new ones added. I have waited so long for this a few more weeks isn't going to make much difference.

    Or taken any action to reduce the incidence of valid claims....
