    The only thing I would remove/amend is this because I don't like to re-state the claimant's case, can't see the point:
    Purported Basis of Claim

    6. Further based upon the scant and deficient details contained in the Particulars of Claim and correspondence, it appears to be the claimant’s case that :

    a. There was a contract formed by the defendant and the claimant on the dates of alleged breaches of contract.

    b. There was an agreement to pay a sums or parking charges.

    c. That there were Terms and Conditions prominently displayed around the site.

    d. That in addition to the Parking charge there was an agreement to pay additional and unspecified additional sums.

    e. The claimant company fully complied with their obligations within the terms of Schedule 4 of the Protection of Freedoms Act 2012.

    f. The claimant company fully complied with their obligations within the British Parking Association Code of Practice of which they were member at the time.

    g. Further that the defendant has not paid the alleged debt.

    Right, so after sending out my defence on the 13th of April (1st Class Signed for) they received it on the 24th... 11 days later.... it was too late and the judgement has been entered against me.

    After talking to Royal Mail and the court basically they said : "tough". :eek: That's about it. The only option now is to pay the court 255 pounds for them to consider to set the judgment aside. I am a bit stuck on the application, maybe you guys can help.

    They are asking me if I need a hearing for this particular aplication.. All I have to show is the proof of sending receipt with their address on it. Do I really need a hearing just to prove this? Am I getting this right? This is just for this application and not this actual case right? And then what if they accept it? We start from the beginning ? Many Thanks

    Do you have a receipt/proof of postage with the date on?
