BW Legal and Excel

Hi all,

I'm due in court on wednesday for four PCNs. I had got a lay representative who has let me down with submitting a defense and also in turning up on wednesday. So basically I'm knackered and this is a last ditch attempt.

The car was allegedly parked without a permit on an excel car park. I hired PPA (John Wilkie) who has since disappeared off the face of the planet. Useful.

I had a folder sent dated 14th feb saying:

Dear Sir,

Out Client: Excel Parking Ltd
Balance Due: £240

Please find enclosed the claimant's witness evidence for the following cases:

CASE1
CASE2
CASE3
CASE4


(Replace case 1-4 with their ref number)

I've taken this as the total amount for all four, given work and the likelihood of winning I thought sod it and paid the £240... Theyve just called to say I still owe £720 for the other three?! !!!!!!?

I've tried arguing the toss saying the letter stapled to the front of the folder states thats the due balance and got nowhere, they're saying the £240 is only for one ticket? They've issued a refund for the £240 and are now proceeding to court on Wednesday.

!!!!!! am I supposed to do here? How is this even fair?

    I wonder if the court would give you another date if you told them you had an embarrassing bowel condition?

    You have a claim for £240 which they may or may not win.

    If they win, they'll be after the others but each case is decided on its merits. If they lose the first, it will be difficult for them to come after the others.

    It would appear in their greed not to have informed you of this.

    But to the case in hand. Did you put in a defence and a Witness Statement. Have you had their pack yet and what does it say?

    It's fought on the facts and nothing else. What are the facts and have you sent them to the court? For example where was it, what was the allegation and is it true?

    No, they're saying I owe another £720 on top of the £240 I've paid!! They're saying £240 per pcn!

    I think I've submitted a defence? I had a lay representative (John Wilkie of Private Parking Appeals) helping me who was supposed to come to court but I cant get hold of him now!

    I'm really lost!

    I've sent a "response to claim" which was done online which John Wilkie wrote for me. I've submitted nothing else.

    The allegation was that my cars (two different ones, I sold one after the pcn) on 4 separate occasions were parked on a car park where a permit was needed. However the photos show that the permit wasn't shown.

    When you say hired, are you actually paying/were intending to pay PPA/John Wilkie to act as a lay representative?

    I paid the £19 or whatever it is on their site. If they needed more money I would have paid, however they've represented others in court for £19. I did ask how he wasn't making a loss, but he assured me he wasn't and it was fine.

    They are now just ignoring emails.
