    NEVER ask for information - NEVER , NEVER , NEVER , this isnt a dialogue

    the template is a "catch all" for all BPA members, it also avoids numpties adding details about "what happened" and especially if they infer or let slip the name of the driver (because if anyone knows what happened its the driver)

    there is nothing wrong in ADDING a line or two indicating that this was a case of "double dipping" because the KEEPER is now aware that the vehicle was there twice on the same day and their ANPR cameras and computers have failed yet again to detect this (its a very common error as seen on pranksters blogs , nothing "odd" about it at all , its a daily occurrence)

    so yes , tell them to check their machines and FRO !!!

    so by all means add a line mentioning this (as long as the keeper believes its true) and they may well cancel, which is always a bonus , but if they dont cancel the aim is a popla code where the big guns are brought out

    the appeal template is a warning shot across their bows , cancel or else it gets more interesting and dirty , where the gloves come off and I will try to make you lose about £30 at popla

    Dear Park Watch

    Re PCN number: XX

    I am the keeper of the vehicle and am aware of your purported 'parking charge'. The driver will not be identified. I require the following information so that I can make an informed decision:

    1. Who is the party that contracted with your company?
    2. Is your charge based on damages for breach of contract? Answer yes or no.
    3. Please provide photos of the signs that you say were on site and which you contend formed a contract with the driver.
    4. Please provide all photographs taken of this vehicle.
    5. Please provide proof that the timing of any camera used was synchronised with all other cameras and/or systems & machines.

    Additionally it should be noted the identified vehicle entered and left the xxx parking area twice, with sufficient break in between. On this basis your technology should, according to its declared accuracy, have taken sufficient photos and your validation process detected these separate events occurring.

    Do not send debt collector letters and do not add any costs which would be a thinly-veiled attempt at 'double recovery'. I will not respond to debt collectors and to involve a third party would be a failure to mitigate your costs as well as deliberate and knowing misuse of my data.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause (e.g. if you do not fully comply with the IPC Code of Practice in terms of signage at this site, for example) please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach.

    For the avoidance of doubt, I do not give you consent to process data relating to me or this vehicle, whether you have already obtained it or not. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days.

Plus your staff should have ensured the same manual checks were made prior to obtaining DVLA data.

    So we posted the letter on the 27th of February and have had no reply and heard nothing else since.

    I gave them the statutory 21 days.

    Do we just wait in case they might reply or are they actually in a worst scenario regarding this lack of response? We've literally had nothing...

    Happened to be in the car park of doom the other day and noticed a few of the cameras seem to have been removed....

    Can you prove posting it?

    If so, do an online complaint to the ICO that this firm has ignored a Section 10 'objection to processing' letter.
