Can my boss come to my private home?


I rent a house on private property owned by my landlord, it is accessed by a lengthy private driveway off a busy road. There are other tenanted buildings close to mine, also the landlords live on the same site as well. The company I work for want to start delivering parts/spares to my home address between 10pm Friday NIGHT and 5am Saturday morning. I have so far refused them permission - the disturbance will affect my neighbours & landlords (security lights coming on, noise/van doors banging, dogs starting to bark etc etc). I explained to my boss my situation but they are still insisting on this delivery scheme to my home address. My boss admitted he had driven to my address and come down the private driveway - All without notice or my permission - Is this acceptable?

  • It sounds as if you are going to have to carry right on being insistent that the landlord won't allow it.

    It would certainly be most unreasonable for your employer to expect to put out the neighbours to suit themselves and your neighbours would obviously get upset with you if you allowed this.

    Check your tenancy agreement. There is probably some sort of clause there about a right to "peaceful enjoyment" or some such in there that would preclude undue noise in the middle of the night. At which point you just turn round to this unreasonable employer and state "point x on my tenancy agreement says xyz and, accordingly, I will be unable to take night-time deliveries - as I would breach my tenancy agreement". Do it in writing and keep a copy of it.

    It's unusual for an employer to come to your home, but it's not illegal.

    If you don't want delivery during the night, that's fair enough. I don't expect you want to be woken during the night any more than your landlord does. However, you may find yourself out of a job.

    Is there any compromise possible? If it's a long driveway, could the items be left at the end of the driveway near the road without disturbing anyone? Do you have a van for the job, and could the items be put inside it?

    Whenever I've rented there have been clauses in the tenancy agreement about carrying out business dealings from the property, in that it has been expressly forbidden. It might be worthwhile getting your tenancy out and checking to see if there's anything in there that would show that this isn't allowed.

    Can you get your Landlord to write a note to say that he won't allow for this to happen?

    Are you expected to be awake at this time and also what time do you start work. Will you be paid for the deliveries because your not going to get restful sleep if he expects you to be in the next day.

    How do you get them at the moment?

    My immediate thoughts were the same as Callie22. Many tenancies forbid the use of the premises for business purposes. Having work related items delivered to your home would break that rule. Secondly, persistent disturbance of neighbours could also be ground to terminate your tenancy.

    I agree with all this. Why does this delivery need to be made to your house? Seems like an incredibly unusual situation to me.

    As well as the questions above is there not a business premises this delivery can be made to? Can it not be delivered to your bosses house if he is so insistent it's delivered to a residential address? Is he offering to pay you for this period? Where do they get delivered to at the moment?

    Anyway there is nothing stopping him approaching your property but he can't force you to accept the deliveries. I'd be insistent on this.

    Were I your neighbour I'd be accepting as a one off. However if this was every week I'd be asking you to stop it and would escalate it as far as necessary, even if it meant you being evicted and/or arrested. With your landlord living near I'd imagine eviction is more likely, although even the best case scenario would be a bunch of upset neighbours.

    When my Ex was lodging weekdays across the country, he couldn't take deliveries of stock/equipment during the night either; so the company rented a lockbox at a local garage (similar to the parcel pickup box arrangements you see) and would drop the stock there for him to collect first thing in the morning.
