Not at ANY point did the BMW owner tell us the age of the car. It could quite easily have been something quite old, but pristinely kept.
Not at ANY point did the BMW owner say they had no spare cash and were struggling to make ends meet.
An awful lot of assuming by people with chips on their shoulders on that thread - as someone on it said, the guy should repost it saying he drove a Nissan and he would have got more objective responses.
Do you think if someone damages your car he should say "No, No, dont worry about it, i drive a BMW, i can afford to pay for your mistakes for you"?
And £190 sounds about right for spraying a wing - it doesnt cost more to spray a BMW wing than a Mondeo wing BTW.
If someone damaged my Pride & Joy i'd be seriously narked about it too.

If it's fully comp, then yes - you give the insurer full details and they will decide whether there's mileage in recovering the costs. They will need to be told anyway, regardless, so it's a bit of a non-question really.0 -

Agreed, however thats not what i'm referrng to - it was your comments that he was a BMW driver who couldnt afford to have his car fixed, and that he was living on the bread line and if he had a mortgage chances are with the rate rise he couldnt afford to pay it.

I take it you read the thread. There was an inability to find a loose £190. That is living close to the edge.
He seemed to have a few supporters for some reason, seemingly people who value their possessions and a couple of hundred quid more than the well being of a little child, and were prepared to elucidate the minutiae of financing car ownership, none of which he countered.
I appreciate everyone’s different, and I seem not to have inherited the car- philia gene (car-yotype?), but I’d reserve the term Pride and Joy for the living, breathing products of my and mrs. yuiop’s biology rather that some generic metal box from a motor works in Mannheim.
I might even buy something nice when the mondeo goes to its eternal rust up on blocks in some bloke’s backyard, but I will not be so unnaturally in love with it that I will whinge if it gets damaged in a collision with a pedestrian. Heres every word they spoke on the subject, just to make it easy for you. Can you show me where he said he COULDNT pay it, OR that it was on finance, OR that it was a new car OR that they were otherwise heavily mortgaged?
Please feel free to enlighten us - go on, highlight or extract the words below that back up your clearly not prejudiced view of the guy based on you not having a chip on your shoulder about people who have a nice car.
"An 8 year old boy ran out into the road at full speed and hit the side of my car. I stopped and checked he was okay, he had minor bruising but was taken in an ambulance for a checkup and is perfectly fine. My car is not. After speaking to the kids mother, her response was "thats what your insurance is for". So I'm thinking of taking it to a small claims court. Police attended the scene and I was given a log number and breathalysed. The quote for the repair is £190 as thankfully, all the damage was contained the off-side front wing of my 3 series bmw which WAS immaculate.
I know I'm going to get nowhere with this woman paying me without an official letter going through her door, but I want to know if this is something a small claims court can deal with?
Regardless of it being an accident on the kids part, he has still caused damage to someones property to which his parents should be responsible for?
He has dented the wing in 3 places, most importantly along the crease of the wing which thankfully can be shaped back and sprayed rather than a whole new wing. There is no question of doubt the damage on my car was from the impact of the kid and theres no doubt he has minor bruising so what would be hard for a court to understand?
I was under the impression a small claims court didn't require all involved to stand before a judge. I was told it would be a letter through the door with a claim for damages?

If my child has caused damage to someones car by running out into the road, you can bet your bottom dollar I would pay for the damage. As would any responsible adult I would have hoped. Why should I have to pay for damage done to my car regardless of how it happened?
Definitely not, if they catch a whiff of it, I'll pay that £190 each year for 5 years whether a claim was made or not.
Societys child, I dont know where who the letter would come from.
I'm here because I don't know if a small claims court is the right solution!

about 6 adults, who have all messaged me on facebook to see if I was okay, 2 elderly whitnesses who passed their details to me and also stopped to tell the parents what had happened. Anything else?

Car 54, yes, I have plenty of witnesses, two elderly people in a car who gave way to me a moment before the impact, I was travelling at less than 20mph on a 20mph road as I had just come to a complete stop to give way to this couple who decided to let me go first, then the 'collision' happened.
I'm not intending to hide it from my insurers, I haven't told them for the same reason everyone here wouldn't.

Anyway, thanks to the people who have took time to genuinely ADVISE me, afterall, all I asked was if a small claims court was the right solution. Have a good day to you guys!

If someone damages your property it is not unreasonable to have an expectation that they will pay for it. If my child damaged someones property i would pay for it. End of.
In the O/Ps situation however, I'd pay it myself as i have no expectation at all that your typical parent these days has any sense of responsibility.

I was brought up to respect and look after things i owned. I was also brought up to respect other people and their property.
If someone has something nice that they clearly look after, that is their prerogative and its not up to me to make little of that.
I was also brought up to believe its not OK to damage other peoples property and not offer to make it right.

Well maybe you respect yourself and your property that little that you dont care if someone else damages it or maybe you're just happy to pay for other peoples lack of ownership and carelessness.

Well that was a lot of work to make a few fairly pointless points. Perhaps you’ve never experienced that cold sweat of horror when someone steps out into the road in front of you and you realise you could have killed them? In this case, the boy made contact with the car and supposedly dented the wing in three places - still think you can fix that for £190? I have to say in my case, the dent would go unrepaired, because it wouldn’t be worth it, and I’d be counting myself extremely lucky that a boy who went off in an ambulance was all right. I’d happily pay £190 to avoid that incident, and I’m appalled that anyone can be so contemptuous that they’d think otherwise. Of course someone running out into the road is to blame, but the driver is in charge of three quarters of a ton of metal. As for people asking is he all right? Yes, he is a horrible person, and it makes no difference to me whether he’s in a Ferrari or on an elderly Honda 90 scooter, he’s still a self obsessed narcissist. Most normal people? Who do you hang around with? Reminds me of an Indian who told me with a completely straight face that “most people in India have servants”.
