Distance selling regs for Europe

Hi, some time ago I ordered a "Fairphone". I have an email receipt from 18 Jan. I did read at the time that it wouldn't be delivered for a while. At the bottom of my email receipt, it says it will be delivered by 31 May. Basically I got sick of waiting and bought another phone.


So now I want a refund on this one, but I haven't got a clue what my rights are because (1) it hasn't actually been delivered and (2) they're based in Amsterdam.


I know that for the UK, I'm covered by distance selling regulations but I thought this applies only when you've actually received the item, so what happens if it's still on order and you haven't received it? And what happens if the item comes from outside the UK?
