Fistral beach overstay
NIpark
I would love some advice please. My query relates to a parking charge for overstaying at fistral beach in 2015. We were on holiday from Northern Ireland and are not familiar with private companies as we thankfully don't have very many. We, in error, thought that our time limit meant we had to return to the car before our time elapsed i.e. an hour after you buy your ticket. We didn't realise your time seems to start as soon as you drive in. So we entered the car park. By the time we got parked up and bought the ticket we had been there about 5 minutes. We paid for an hour and returned to our car on time. However our small children needed to be dried after playing in the water. We left 10-15mins after returning to the car. A few days after returning home a penalty notice for overstaying arrived which my husband chose to ignore as these are not really enforced when issued by private companies in NI. We got a couple more letters and then nothing. Now nearly 2 yrs later we have a letter from Gladstone and I am very concerned! Any ideas where we stand. Thanks in advance.

It's not a fine or a penalty.
The advice if you live in NI is to ignore as only the driver can be held liable. There is no POFA 2012 like we have in England or Wales that can transfer liability to the keeper.
I would wait for the more experienced to reply but I think you either continue to ignore, or write to Gladrags and tell them to contact the driver as the keeper is not liable in NI.
Of course you don't tell them who the driver is. That's for them to find out, which they can't do if you don't tell them.
Anyway, don't panic and wait for the more knowlegeable regulars to come along and help.I married my cousin. I had to...I don't have a sister.

Thanks guys. Parking co was smart pk.
Ah, as TrevorWhitehousesCat says, this Gladstones letter (with the WRONG 'Red Cow Yard' address?) will in fact be part of a toothless debt collector (Debt Recovery Plus) letter chain then:

Sit tight. You are untouchable in NI. Smart Parking have never sued anyone and can't hold a registered keeper liable anyway, so NEVER say who was driving. This letter is more debt collector fluff.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

yup, the split personality of DRP who play silly games.
One day they pretend they are debt collectors, next they play at being Gladstones ???
You have got to agree they are turkeys (sorry turkeys, I do accept you are smarter than DRP)
The real Gladstones, what a joke, a disgrace to the legal industry
Smart ... low life scammers
Northern Ireland ...... these idiots know it#s a no go area and Smart will do nothing
Enjoy your life, forget about DRP, SMART. GLADSTONES
