    I didn't know about this case, but have read the thread on here about it.

    Does anybody have any further information on the case? I can only find references to it on here and another forum.

    Without knowing the full facts of the other case, I would not rely on the term being found to be unfair.

    I didn't mean to delete my original post, just went a bit blonde when quoting myself! x

    Special delivery next day guarantee will be suspended during the strike but will be in action before and shortly after so you should be able to get it delivered within your 14 day window using this. Cheaper than a carrier. As has been said it is worth spending a bit to be sure that you get it in on time - there's a lot of money at risk here.

    Hi Martin,

    Sure. The problem is not delivering it to bmp.net. The problem is that I might not receive it from ORANGE because of the strike so I don't have anything to send to bmp.net

    If you don't receive your bill in time, then send them a letter (by special delivery) stating in full the problem, to arrive prior to the deadline, giving chapter and verse of the dates. State that you will send the required documents as soon as you have them to hand. Keep a copy of this letter.

    It is not bmp's fault you cannot comply with the contract. Likewise it is not your fault either.

    If they refuse to pay up, then write to them pointing out the Force Majeur which caused the problem, and your efforts to appraise them that this would happen.

    If they still refuse to pay, then issue a summons for the money owed, stating that the breach happened due to these circumstances.

    If they don't pay up then, a court hearing will be necessary, but you will win providing everything else you have done is in accordance with the contract.
