Compensation for putting someone else court judgenents in my credit report

Hello to all members,
My ever first post here,
in my credit report there are 2 court judgements and decrees but that was not me.
The person owe same name as me but only one spelling difference in his surname but most important thing is he born in 64 and i born in 80.
i ve recently tried to rent a home and letting reference provided adverse credit history which turned me down because the house i am living i need to leave but cant untill its sorted and its taking !!!!.
The debt is from Halifax and debt collector is chasing me since 5 years now.
they keep threaten me,
even last year i petsonally went to Halifax and spoke to debt collector they said its fine i will not receive any more letter.
Now i complaint it and beenntold will remove from my report within 6 weeks.
I am taking it very seriously and going to raise this matter and looking compensation.
Could you please provide me advice who to sue,Halifax or debt collector?
and anyone can provide a compensation template letter?

    You dealing with them for 5 years and not yet find them its the wrong person?
  • Well its 5 years i am receiving letter and i was dealt with it always spoke ro them that its not me But i never know its in my credit file.
    I recently turn down by a letting company that i havd bad credit history then i ordered a report and find there are 2 judgements and decrees there under my name which is not me.

    There will be no compensation.

    Your recourse is to request the statutory 2 quid copy of file from all the CRAs, report inaccurate entries to them and then they will be removed. And that is all, problem solved and gone.

    If you've suffered any material losses as a result of this CRA malpractice you could sue Halifax, the scum, and maybe the CRAs. In any event, report them to the ICO. Maybe you could find a solicitor who does 30 minutes advice for a small charge - see what they have to say.

    And what are your grounds councillor? Not slogans, actual grounds for a lawsuit.
    Because you can sue anyone for anything, but you will be throwing money down the drain here.

    And? Which part of that answers any of the questions i've asked?
    With the amount of time you put here blaming CRAs and suggesting lawsuits, you get a law degree which you could then use to "fight the cras", or whatever you please. Have you considered going that route?

    The incorrect information on your credit file is in breach of the Data Protection Act, which legislates that any data held must be accurate, which this is not. However, you may still be looking at spending a lot of money for potentially no or little gain following up the legal route, I think your priority is the fix the issue- if the credit has been incorrectly reported by Halifax they should fix this, they have the ability to contact the credit reference agency to correct any incorrect entries which they have reported. However, it sounds like they have reported correctly, and the issue is that your credit file has been linked to someone who is not yourself. Have you checked the 'aliases' section of your credit report? Ensure you 'unlink' yourself from any aliases which are not you. There is also means of reporting incorrect entries on your report- ensure you do this will all the big three- eqperian, equifax (clearscore) and call credit (noddle)
