I need help

Good afternoon
I desperately need help and advice. I recently discovered by chance looking at my credit file that a CCJ has been obtained for a Parking charge I knew nothing about by Gladstone's solicitors in November 2016

It relates to my Son's car of which I am the registered keeper but have never driven. I contacted Gladstone's and explained this to them. They suggested I pay them to obtain a notice of correction on my behalf at a cost of I think £255.

I couldn't afford to do this. Previous to this my credit file has been completely clean.

Today I have received a Notice of Debt Recovery from DCBL to recover the debt on Gladstones behalf. They have added a further £75 + VAT administration and recovery fee taking the total to £342.88.

I can't pay this and don't know what to do now? All help and /or suggestions will be very gratefully received. Thank you.

What prior paperwork have you/son received from Gladstones?

Have you moved address in the past few years and not updated this with the DVLA?

    Which parking company is involved?

You can't clean up your credit record without paying for a 'set-aside' (£255, or there is some reduction if on benefits), but you will need to have good reasons why you did not defend the case. Then you might likely have to defend your case in court to get rid of the charge. Google 'set-aside'.

Others will be along with more experience, but, for the moment don't go paying Gladstones anything until you get further advice.

Does the DCBL letter specifically state that they are not acting as bailiffs in this case (check carefully the wording - second page of letter, I think)?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • nice move by gladstones , wait till person with CCL contacts them , get new address then send in the dogs!

check the wording on the DCBL letter and prepare for a set aside , if you are on a low income you can get assistance (I think?) Mr Gladstones Idea of a "notice of correction" , would be after you paid the CCJ off , they would mark it as satisfied , still mucking up your credit

you need a setaside , which winds the clock back , and if they want to restart court action you fight the !!!!!!s

there is a tight time limit to get things rolling , who was the parking Co

    Hi
I don't know who the parking company are as I had never received any paperwork from anyone. I just came across the CCJ when looking at my clear score!

The letter from DCBL just says the amount has been passed to them to recover the debt on Gladstone's behalf. I couldn't appeal anything I knew nothing about.

See above - will be explained very accurately.

Why don't posters answer important questions; they're not asked just for the sake of it? Makes this such an uphill struggle at times!

Search this forum for the phrase 'set-aside' and you will find LOADS of people doing this (wiping the CCJ) and then successfully defending the claim. It costs £255 unless you are on benefits and qualify for help with court fees (Google it).

    Do NOT do this:
I contacted Gladstone's and explained this to them. They suggested I pay them to obtain a notice of correction on my behalf at a cost of I think £255.

    NONONO.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • The letter from DCBL is only one page. It does t make any reference to them not acting as bailiffs but does say that a failure to address within 14 days will result in my case being reviewed for legal recovery incurring further cost!
  • I have lived at my current address for 27 years.
