FloGas Contract Price Increase - Legal?

I live on a small estate of 12 properties where all houses are supplied by metered FloGas from underground storage tanks.
In September 2016 the residents, under an umbrella agreement, signed up to a 2 year contract at a set price of 150.00ppm (38.96ppl).
From the contract, it states "This means each property is only tied into the contract for 2 years as of the 20/09/2016 and the whole estate will come out of contract at the same time on the 19/09/2018 regardless of any movement in or out of the estate".
Then on 9th December 2016 we received a letter from FloGas informing us that from 1st January 2017 the price will be increased by 4.6 pence per litre.

Is this price increase whilst in contract legal?

I would be grateful for any informed advice. Thank you.

    Going on the post details, the price rise appears to be out of order.

    However FloGas aren't amateurs in the Gas Supply business, and it's a fair bet that somewhere in the T&C's of this contract, FG have the right to change the price - Look hard at the very, very small print.

    Agree with the post above. If you have doubts ask FloGas to point out in writing the clause in the contract that allows them to raise prices.

    I suspect it will be on page 14, paragraph 118(d) (5) (ii) footnote 37;)
  • Flogas have form in this area. I was only with them for a year or so (and admittedly I was "out of contract") but they increased the ppl several times. That said they did always write to me telling me how it pained them to increase the price and they appreciated the difficulty this caused their customers but their hands were tied. Bless their cottons. Still left them at the first opportunity I had though!
