Hi everyone,

I was wondering if anyone could give me a bit of advice. I've read the stickies but I'm still unsure what to do as I realise that technically the driver was in the wrong.

I have received a PCN (which included photos of the vehicle and the signage) by post from UKPS Ltd in respect of parking in a car park without a permit. The small car park is behind a bank and some shops and for many years was open to the public providing you were a customer.

On 26/01/17 the driver used it for 5 minutes while they went to pay some cash in at the bank. This was the first time the driver had been there for several months and during that time it would appear that the car park has become 'Permit Holders Only'. The driver failed to notice the new signage and I have been today to have a look at it. The signs are prominent on the entrance to the car park and also on the walls inside (how the driver failed to spot them last month they really couldn't say :embarasse).

Anyway, the driver realises that yes they were in the wrong but how can UKPS justify a £65 charge (increasing to £100 if not paid within 14 days) for a 5 minute stay? If it was a more reasonable amount then I would just pay up but I really do think that this is excessive.

What do you think? Should I just pay and chalk it up to the drivers stupidity in not seeing the new signs or ignore it in the hope that it won't get as far as court. I don't think I have any grounds to appeal do I?

    Yes, everyone does! NO-ONE HERE PAYS.

    But as UKPS (if this same firm as this link below) have form for sending very very late Notice to Keeper letters i would sit tight and wait for that first letter from TNC, which will give you scope to complain like here:

    So, as long as this is your car at the DVLA (not a company or lease car) keep the PCN safe and wait for the daft TNC rubbish and count the days in between...more than 57 days between PCN and NTK means they can't hold you liable as keeper (and so, hey presto, there is a slam dunk appeal AND a reason to complain and get it cancelled).

    That is, if this 'UKPS' (there are a few) is UK Parking Solutions, the one on the BPA approved operators (AOS) webpage, shown as T R Luckins Limited t/a UK Parking Solutions. Is it them? If so, trust us, sit tight for now and come back when you get the daft TNC drivel.

    What you seem to have missed in all this is that the entire industry is rotten. Hence why we help everyone to beat the lot of them, as best we can, never mind what happened.

    No, the company is UKPS Ltd of Central Office, The Hangers, Harbury Lane, Leamington Spa, CV33 9SA.

    It is a member of IPC not BPA and I think it is relatively new.

    Do I still just sit tight?

    Well either that or send one challenge as per the NEWBIES thread but I would actually wait for the first letter to arrive to the keeper's address next month (or later) if so far this has only been a windscreen PCN.

    I am planning to change the advice in the NEWBIES thread any day now for IPC firms. As there is no appeal worth trying with this 'IPC' bunch (and a person is in a better position in some cases if they let the PPC get the DVLA data, because of the complaints that can arise from the misuse of that data) I am going to recommend waiting for the NTK, with all IPC firms.

    Unless the consensus of regulars disagree?

    Not so with BPA firms, no need, as they are almost all winnable at POPLA.

    as the tv ad says "every little helps" , I can forsee a fightback with regard to DPA and other failures starting soon

    C-M no it wasn't a windscreen PCN, it came through the post stating that they had requested the details of the Registered Keeper from DVLA through the Reasonable Cause criteria of pursuing an outstanding parking charge. There was no PCN on the windscreen whatsoever.

    Does this make any difference?

    Incident Date on the PCN is 26/01/17, PCN Issued Date is 13/02/17 and the franking date on the envelope is 14/02/17. It arrived by post yesterday 15/02/17.
