Well this is what was written..'I took the item on holiday and after 3 week it developed a fault. I would like to return it' under a return request defective / not as described.
He omitted to say the fault developed as it was dropped. But regardless, the item clearly arrived working and worked for 3 weeks. This is written in the Case! So I cannot see any argument to say that Ebay did not offer him a guarantee. I know what the T&Cs say, but I do not believe Ebay actually read the text and will always go in favour of the buyer, so in effect there is a de facto guarantee.
As I said, I am wondering how to persue this, but it is clear from the handling here where the buyer admits the fault developed after 3 week, omitting to say it was dropped, Ebay did offer a guarantee in all but name.
I think it is naive to assume they do not. I suspect Ebay would have told him to send it back if he had written, 'dropped it, doesn't work now' too be honest!
I judge Ebay by their actions, not their words.0 -
[If they have simply changed their mind, they will have to pay for the return postage. If the item is faulty, the buyer has 30 days from the estimated delivery date to return the item and you will have to pay for return postage.]
The above taken from the ebay website for returns. So Ebay are saying in a way you are giving a 30 day guarantee!0
