  • Yes the notice of prosecution was sent to my home address after my employer declared me as the driver. They money for the fine left my account and even though they've said the money has been refunded I am yet to receive it.

    You then got your own NIP/s172, identified yourself, signed it and returned it within the time limit?


    Then you got an offer of a fixed penalty, accepted it in time, and paid it?


    But you're still being prosecuted for failure to reply to the 172? Or is it the speeding or both?
  • I'm being charged with both. I paid the fine and sent the forms with my licence. They received the money but the forms have obviously been lost in transit.

    If the money was taken from your account then surely that means they received the paperwork? Or did you pay online?

    The fact he had the fpn means he's not guilty of the criminal 172 offence.

    He needs to get his evidence together and attend court. If he explains all this and pleads guilty to speeding there's a good chance he'll get £100 find plus the victim surcharge and no costs.
