Single Justice Procedure Notice

OK, need advice
I was caught on camera towards the end of last year and recived a speeding fine. I paid the fine and sent the relevant documents off along with my licence. This weekend I recived a SJPD form with the charges off
Fail to give information relating to the identification of the driver and Exeeding a variable speed limit.
I'd totally forgotten about the original fine and since this form has come through I've realised I haven't actually had my licence back. Also should there not be some sort of reminder ? They say they've refunded my original fine cost but this is also something that I have not received.
Now I'm expected to plead guilty or not guilty ? To what ? As far as I'm aware I followed the procedure to the letter ?

  • Plead not guilty to the 172 offence, if they issued you a fpn then how could they do that if you'd not responded?
  • I'm not sure, I have copies of the fixed penalty and reply to notice form which were sent of with my licence and proof of payment. The original notice was sent to my employer as it's a works vehicle then returned with my details.
  • Sounds like your licence and letter got lost in the post. Did you get free proof of postage when you posted it?
    Seek legal advice from lawyer or CAB for next steps.
    Technically you are not guilty as you did return the doc through the royal mail which is an acceptable form of delivery and a proof of postage would prove this.

    Also you will need to apply for a new licence as yours is now lost. Take a screen grab of the confirmation page when applying as evidence that your licence has been lost.

    At this stage don't plead guilty to anything until you have sought advice. This will need to be sorted out at court and it will cost you a little more than it should have done since there is no getting around the Victims surcharge. It should be treated as at the same level of the FPN since you have failed to keep to the requirements through no fault of your own. Though it will be £130 you pay and not £100.

    This is incomplete advice since depending on the OP's speed he may end up getting fined more or given more points if he pleads guilty to the speeding at this stage.

    At this stage he should plead not guilty and make both charges be taken to a normal court.
  • I was doing 68mph in a 60 zone. Stupidly I just posted it normal post, in a letter box I've had speeding fines before and posting normally has been fine. What I don't understand is why you don't get some sort of reminder especially as I'd already paid the fine ! On a previous fine about 6-7 years ago I completely forgot to pay or acknowledge for the full 28 days and a warning was sent giving me another 14 days. Also how come I've not recived any refund like it says for the original fine ?

    He was given a fixed penalty and will have an arguement at court he should be sentenced inline with the ticket. i.e. He should not be disadvantaged by their error.
  • Post #3 - so the original NIP/172 went to your employer who supplied your details(?) and you paid the fine(?).

    Did you actually have the paperwork in your name? By that sent to you after the company returned their paperwork.

    You said your fine has been refunded, did they ever take the money?
