Parking Notice by PCM for Not Displaying Permit

Hello,

My mother received a parking notice due to not displaying her parking permit/disabled badge.She's not very well at the moment which is why she has a disabled badge, and this parking notice is causing her a lot of distress.

I know technically, she was in the wrong for not displaying her permit/badge but do we have any rights to appeal this? Or should we just pay the fine?

She had been issued a private parking fine by Parking Control Management (PCM) who is a member of the IPC.

I have read the newbies thread so I am aware that it order to appeal I must write a letter without providing the address or name of the keeper. But could someone explain to me how they will respond to my letter if I have not included a correspondence address. PCM does not have an email address I can find and will only accept appeal via their website which you must enter your name and address to do.

    I don't say not to give the name and address of the keeper - of course you have to! The template says 'name and address of keeper' at the bottom of the letter.

    You just do not name the DRIVER. Not the same thing at all.

  • What are the other details of the parking signage? Was it pay & display? Was parking prohibited? Where was the car parked? As others note, do not identify the driver.
    Based on my experience with PCM, do not respond to the Parking Charge Notice attached to the car. Eventually you will get a Notice to Keeper that will probably not be compliant with the relevant law (PoFA). Based on standard PCM signage, they probably made a forbidding offer and so there would be no contract. You can probably avoid paying the charge in the long run but distress /stress levels will likely get worse before they get better.

    The NEWBIES tells you to appeal a windscreen ticket as keeper, not wait for the NTK, as this often causes the scammers to forget to send an NTK at all.

    Where was the PCN issued? Was this for residential parking? If so, what does her lease/tenancy agreement say about parking?

  • It was park in a residential car park which my mother has a permit for but on that day it was not on display.

    The signs say parking for permit holder only.

  • I think the car park is managed by PCM but it may be owned by the council.
    Nevertheless you need a permit to park there.

    PCM don't work for Councils - is it a Housing Association residential car park where your Mum lives?

    Are you sure you need a permit to park there?
    It wouldn't be the first time pcm have made up some rules, as ever the lease is key.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
  • Well all the houses/flats where my mum lives are own by the council unless bought privately.

    The car park used to be free for anyone to park there, but resident complain about others who do not live here, using up the parking spaces.

    The only thing is that my mums permit was issued by the council but the sign in the car park is by PCM.
  • And yes you definitely need a permit to park there.

    This is the first time my mum has been given a parking ticket there and she has lived here for over 20 years.
