6 hours weather related delay.

Hello. I'm slightly confused about the guidelines relating to compensation on delays over 5 hours. Whilst awaiting my 4 hour weather delayed Easyjet flight on Sunday from Fuerventura to Gatwick, I'm sure I read online somewhere that regardless of the reason for the delay, if your arrival time is more than 5 hours, compensation is automatically due. Well we took off 4 hours late and after diverting to Lisbon to pick up new crew, we arrived in Gatwick 6 hours late. Can they wriggle out of it still due to weather problems? Thanks.

the question is...was the delay within the control of the airline so they are made to pay compensation
Weather delays are not in the control of the airline so no compensation due
The reference to 5 hours may be confusing when you choose not to travel on a delayed flight...under 5 hours you get a refund, over 5 hours you get refund plus compensation assuming the reason for the delay is covered
You would be due reimbursement of refreshments etc under EU261 Duty of Care only unless it can be proved that more than 3 hours of the total delay was not due to weather0 -
I would say that no compensation is due.
If you are delayed because of weather then as this is outside of the airlines control they are not liable.
The delay was compounded by the rerouting to change crew but this appears to only have added 2 hours onto the initial 4 hour weather related delay and a 2 hour delay isn't long enough to claim compo (the minimum required is 3 hours).0 -
So, in a nutshell, they could delay us indefinitely 4,5,6,7 hours or more and cite bad weather (which this was) and not pay out regardless of how late we landed....? Somehow that seems wrong.0

If a flight is delayed due to weather, there is nothing that the airline could do to prevent it so why should they be required to pay compensation for something that was totally outside of their control?0 -
I would love to find ANY airline that can control the weather!!Airlines like the people they carry do not want to have flights delayed for any reason {it costs the money} and I for one would sooner be delayed for 10/12 hours rather than have some cowboy airline risking my life by flying in a situation that could cause a crash.
Just except that weather was the problem and your airline took the right stand and do not need to pay out.0 -

In weather delays ATC will control what aircraft can leave when. The airline has little control over ATC - they will sometimes board the passengers so they are ready to leave when ATC give them a slot (I have sat 2 hour plus 'waiting') but airlines are not responsible for compensating passengers unless the delay is something they could control. During ash cloud people were delayed for days not hours.
You could check your travel insurance policy but many only pay out after 12 hours delay0 -
Thanks...I think! I accept the weather was the problem for the original delay although every other airline...coyboy ones included (Ryanair) managed to land ok when it started to rain! The point is and what grinds my gears is the additional delay due to the diversion and not one member of Sleazyjet had the balls to come confront passengers on the ground and offer any explanation, let alone any refreshment and yes i know i could have bought my own and claim back later but i was all out of cash. So yes, i am annoyed and totally p*****d and then for them to say sorry...bad weather...tough titties!0

If the weather was on a previous rotation and not related to your flight then their 'may' be a claim. You can enter your flight details into one of the NWNF free checkers (EUClaim, bottonline) and see whether they believe there is a valid claim0

If you hate Easyjet that much why do you fly with them?
What really annoys me is that companies like Easyjet,Ryanair etc.made flying cheap,yes they charge for luggage and food but their prices are all there to see and up front however when ever anything goes wrong all we get is people complaining.
I wonder what people would say if it went back to the old days when flying wass only for the well off!0
