Hi Candyapple. The debt is for £650ish.
I asked them to prove it back in December 2016 when I received the court papers and had no response. The only thing they have sent me is the final bill, which was emailed over this morning.
They did say they would sent a notice of assignment but had to request this from their database, nothing yet.0 -
It may be worth noting that they said I made a payment in January 2011, they didn't say for how much, but on my credit file, the records only go as far back as June 2014 so I can't see anything prior to this. No late payment markers, or green dots etc.
They said it defaulted in September 2011 and they had ownership of the debt from October 2011.0 -
That kills the option of trying to get it thrown out for being statute barred. Guess you will have to wait up to the hearing to know whether you had or not this account, it's entirely possible that you did get it in spur of some 18-yo-genius-moment and simply forgotten. Either way have money prepared to pay the judgment, this way it will not show on your credit file, and the default will drop off before the end of this year anyway.0

Mind can play bigger tricks on us than that. One good question to ask will be where/how did you enter the agreement, maybe it will turn out that it was signed in location on other side of the country, but with your details.0

This is a common tactic by debt collecting agencies, to try and reset the clock in not making the debt statute barred. Again, the onus is on them to prove the debt is yours.

Hi, I thought I would provide a quick update.
Lowell said they would provide the proof that the debt was mine and "had to request this" from their database (this was on Tuesday). They said that it could take up to 24 hours.
It's now been 3 days and nothing. Is it worth contacting them and asking them what is going on?0 -
