Is it too late ?

I received a ukpc ltd fine in November of last year for parking in MC Donalds 20 minutes over the allowed time.I didnt realise they had a specific time frame that was aloud however, It was 11 at night and stayed until around 2, i was sat inside eating and talking/ using wifi etc however i have no proof as i paid cash and never keep receipts.

I received the first letter, did some quick research and called mc donalds told them about it, the manager told me not to pay it and they would sort it out.

I received a 2nd letter and ignored it. i have now received a 3rd from a "different" company ? DRP where the fine as gone up and that i should pay or else they will take court action.

  • I have yet to see a MC Donalds with a 2 hr and 40 mins time limit? , why not go back and speak to the manager , photocopy the nasty letter from the parking co , and write your email address on it , ask him to confirm by email when its cancelled

    DR+ ? they are debt collectors , there is a full page about them

    Yes you are too late to appeal.

    But not too late to chase up the manager you spoke to. Point out that his inaction has now resulted in you getting grief off a debt collector.

    Read up the newbies FAQ thread near the top of the forum to learn about the game you are now involved in.

    Keep pressing McDonald's, ignore drp.

    Don't ignore any court correspondence. If you get any come back for advice on preparing a defence

    Firstly you have called it a fine twice, it is not, keep on to Mc D's until you get this sorted out, and no way should you pay the inflated charge that the useless scammers at debt recovery plus have demanded.

    THEY have not actually threatened you with court have they?

    I bet they have given you a load of tosh about if you don't pay us we will recommend to UKPC that they take court action.

    Which they don't actually want as the charge goes back down and they get nothing.
  • Ok so im going to go into mc donalds tomorrow, and yes the court thing says "if you don't pay us we will recommend to UKPC that they take court action". So should i just go into mc donalds and see what they say and thats it or ?

    There's not much else you can do now but you should not contact DR+ and certainly not pay their add on charges.

    You will then be in ignore mode unless the scammers at UKPC try to chance a court claim, but they can only try to get the original charge out of you not plus the debt collectors scam.

    is that the lower first 14 day rate or the higher £100 ?

    The 14 day one is gone now.

    But it's irrelevant as your aim now is not to pay anything at all.

    A few things you need to be aware of before you go in
    This is not a fine
    Are UKPC acting as agents of Mc Donalds, or is this a larger retail park?

    McDoanlds are usually infested with MET parking
    If this is a larger retail park you may need to find out exactly who owns it and who took on UKPC, Most McDonalds are franchises, so this could possibly be a UKPC acting as agents of that McDoanlds Franchise

    If it is a Mcdonalds site, then expect to get fobbed off with the nothing to do with us, again you need to be sure that it is a McDonalds site/operation before you go any further

    If the parking company is acting for and on behalf of that Mc Donalds site....
    You may need to speak to the franchise manager to sort things out, if they call it a fine you could tell them that private companies have no lawful authority to issue fines, and as such you want them to cancel it.
    you will need to remind them that they are legally jointly and severally liable for the actions of their agents.

    If they won't cancel the charge notice, then at the very least try and get a signed letter from them something along the lines of:

    Parking Charge notice __________ issued by UKPC to the registered keeper of vehicle__________ at McDonalds (location)____________
    I (name of manager)__________ am aware of a Parking charge notice issued to the above vehicle by our agents, UKPC who we beleive provide car parking management to our site.
    After speaking with the Registered keeper of the vehicle/customer , We, the Mc Donalds Franchise acting as principal do not wish our agents, UKPC to continue to pursue this parking charge and would like all costs and charges to be dropped/cancelled with immediate effect
    Signed ________________manger acting for and on behalf of of Mc Donalds (location) Date_____________

    Something like that would kill the chances of any court action as they wouldn't have the authority of the landowner/principal.
    You could also use it as a put up, or shut up to the parking company, either take it to court ( where the letter would destroy any case) or thye could possibly face a harassment charge, and/or time wasting at £19 per hour of your time for any further communications, except for as letter confirming the charges are cancelled
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
  • it says pay the full payment stated above then goes on to say " if you dont, well recommend to our client that they take court action against you".
    the only other store on the property is ASDA, so maybe mc donalds didnt do anything because they cant ?
    What should i do if it is asda who do this ? just do the same as i would with mc donalds ?
