Comments

Thank you for the reply, the bill was 1200 pounds.
I just dont like getting ripped off.
So i will persue the matter and as he is local will make sure people know what his work standards are via social media.
I am fed up of getting ripped off.
Sorry for the rant.
I have to work hard for my money and i cant warrant it being given to someone who is intent on doing crap work and wants top dollar for it.
Rant over.

Proceed withe the court action and if successful give the Bailiff the heads up with what assets you belief he may own.
Do not let him get away with it0 -
It may be an idea to pay for an HPI on his bike and car prior to taking him to court.
If you take him to court you can ask them to freeze these assets (if they are his) at the time of judgement.baldly going on...0 -
I know he has a big super bike, a van tools ect so I dont know what else to do.
Thank you for your input

They can't always seize vans and tools:

Do a land registry on his house.
If he owns it then you can put a charge against that which you get when he sells.
It also stacks up interest rates of about 8% a year.
We did this a while ago when someone did a bodge job on our bathroom.
One thing worth noting is that if you do go to court a professional report from a recognized body goes a long long way towards winning. Otherwise its his word against yours.
You can claim back the cost of this if you win (up to about £200).0 -
Ok , Thank you will do a land registry on his ad.
Would the guy who is coming to sort out the problems giving me a report supported with pics be ok.
Thank you.

I have been to Court on this basis and won, but it was a huge risk on my part. Basically the judge weighed up the idiots I was in dispute with and considered my paperwork more convincing and genuine than theirs.
If the Judge considers your replacement builder to be flawed in any way then you may loose your case. That is why an expert witness style report from a qualified professional is the the fail safe route forward. But you should really have this approach before engaging your replacement builder. How do you know if the replacement builder is any good? How do you know exactly what is wrong with the work? How do you know exactly what is requited to put the work right?
If you are going to Court it is imperative you have a water tight case. So far you do not have this.0 -
You'll need to have a report done by a surveyor/decent roofing firm highlighting the problems. They can't just have your word saying the work is !!!!!!. Look on the NFRC website for someone local.
Then you write to the roofer enclosing a copy of the report and ask him to rectify all the problems written on the report.
If he doesn't do that then you can start proceedings and when they do start the fact that you have done the above two things really helps in your favour.
Sorry to hear of your problems.0 -
The builder can not give me a detailed report without taking the guttering down, he did look at the leaking joint and one side has no rubber seal in.
The original person is aware of the problems that I can visually see and has been sent pics of these.
He has stated on numerous occasions that he would sort all of them out, of which I have copies of.
I will be here when the builder comes on Thursday to get more detailed pics to use as evidence.
The builder is aware I will need a summary of the problems he encounters.
Thank you for your input.

Ok an update with the problems.
Work to repair the faults with original person rectified at a cost of £685.00 labour and parts, 180 for scaffold and nearly 60 quid i spent getting extra parts for the gutter.
Feeling very issed off.
The wooden fascia board at the rear of the property was not removed,
the front and side were but i presume for quickness he couldnt be bothered to take it off the rear.
I will be sending the cost of the bill for what the current builder has done to the idiot that initially did the job, what time scale do I give him to pay please before commencing with court proceedings.
Idiots bill was for £1200 the bill for the real builder with the cost of the scaffolding will come to £865.00.
He has not removed the ridges as he has quoted to do so can i bill him for £1200, even though the cost now for doing the ridges will be far higher than the difference between £865 and £1200 as he has just about ruined the ridges with cement.
Again sorry for rant.
