    So, the advice is:-

Write to them informing them who was driving at the time and their address

When a court summons comes reply stating death of driver?

Should the disability be mentioned initially?

Should i give blue badge details in initial letter?

His house has been returned to the landlord so i won't necessarily see any correspondence for him
  • Write to them informing them who was driving at the time and their address

then a letter will come addressed to him , at that point contact the PPC , and inform them of his death , scanned copy of death certificate if necessary , keep track of letters , they have now passed lability to him , not you (you have proof)

That may change things a bit, although Highview are not keen on court anyway (I missed that it was Highview)..

I had a friend who, in September, had 2 Highview tickets. I got them off with an appeal to Highview. One was out of time.

They will roll over if they are told that their NtK is out of time, so I would inform them of the driver's name and address and also point out that there will be an appeal to POPLA for out of time, so please send POPLA code.

Arrange for a mail redirection for a couple of months.

beamerguy may have a point about how you might feel about taking the other route I suggested, it just depends upon how you feel. My family would stuff it to them!

Certainly the out of time point you made can kill it dead

a court summons will not arrive, however if there is a change of address this shold be included in any correspondence sent.

Odds on if you send something like i posted above it will be rejected ( too many words will make the PPC get a headache) if that happens then it will open the flood gates to go for Tesco, who are ultimately responsible for allowing such a shower in their car parks.
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"
  • the address could be the OPs , however the definition of "serviceable" on a deceased person might cause problems ..

    No.
    When a court summons comes
Highview don't do small claims (and small claims do not involve a 'summons').

Just send a copy of his death cert, telling them he was driving and was disabled and how dare they bother you, and they will cancel. I am CERTAIN. If they don't, then complain to Tesco CEO as shown. This is much simpler than it seems.

So sorry to hear about your recent sad loss of your Dad. :(

    OK,

So simply write to them explaining who was driving (may as well include copy of blue badge) and copy of death cert

To me this seems like it should end it as who else can they go after?

Yes, do that. They cannot and they will cancel, IMHO.
