Tesco Highview Parking charge - driver now deceased

I have Charge Notice, Charge Notice Reminder and Legal Action Pending letters from Highview Parking

They are dated 23/11/16, 12/12/16, and 28/12/16

Time in 09:18 Time out 15:08

Date of the 'offence' 6/11/16

My Dad, with a blue badge, was driving my van on this day. He parked in Tesco and used his mobility scooter to visit Tesco and surrounding shops. Taking his time.

I've just got home to find these letters after staying at his house since November

Unfortunately he died on 17/01/17

I wonder what the advice is?

    Tell them who was driving and give his name and address.

    When they contact him at the address, then tell them he has died or do nothing leaving them to issue proceedings against him. At that point, well after they have given up on you, you can tell the court he has died, with a copy of the death certificate.

    If you tell them he is dead first of all, they may not send the charge to him.

    My condolences.

    If you just want this to go away, do as advised above. Initial appeal from the keeper naming the driver, then tell the scammers he has died when they try to contact the driver.

    If you want to make the scammers pay, appeal the PCN as keeper, appeal to PoPLA nas keeper, and then name the driver after you get the result from PoPLA if you have lost.

    I'm sure you have got enough on your mind at the moment so you may just want this to go away.

    Sorry to hear that news.

    You may not be aware. but last year Tesco announced that they were targeting those who park in a disabled bay without a BB.
    This was to be acted out by Tesco staff with a phone app that was sent to the parking company.

    I would contact the CEO of Tesco, telling your story and stating that you will not accept any harassment from either themselves or the parking company and request them to cancel the ticket.
    I doubt Tesco would want to be blasted by the media in these circumstances

    Seriously, I would not inform them of Dad's death till after they have transferred liability to him following you advising them who the driver was and giving the last address he lived in.

    You can then wait till any court papers are received and by that time, sufficient time will have passed to allow them to reasonably claim keeper liability/ You would simply have to tell the court that father died and prove it.

    If the death is published in the Gazette and local paper, then after 60 days, there is no come back on executors.

    purely by looking at the letters (dates) it seems they have exceeded the time period set by the POFa , and therefore cannot go after the owner of the vehicle

    I would go for the short and to the point, and depending 0on how highview respond take it up with Tesco, and take it further..
    you could try something like this, and if they reject then go to the press.
    Make sure that if you take this further that is publicity it is known that Tesco are responsible for the actions of its agents.

    I am writing to you/contacting you regarding the Parking charge notice Ref___) Issued to _____ at the time the driver was a blue badge holder, and had a long term disability that affected his mobility as covered under the Equalities act.
    As a result of this disability He required a few reasonable adjustments to be made, not least extra time to complete his shopping.
    Your indiscriminate use of Automatic Number plate recognition cameras failed to allow for these reasonable adjustments to be made, and asking/requiring those who need extra time to make a special trip/request to customer services or yourselves is by its very virtue discriminatory ( as able bodied people have no such obligation)
    I am hereby informing you that you must take the following action:
    the immediate cessation and discontinuance of your indiscriminate ANPR systems
    The issuing of a full and unreserved apology (a meaningless written gesture of goodwill is not acceptable)
    A payment of £250 to <Charity> which supports people with mobility issues/those with the condition that my Father suffered from.
    Further more as the person you are trying to contact is deceased, your letters are only causing increased grief, harassment and concern at a difficult time for us, and as such you must now cease and desist demanding the payment of this so called parking charge.

    We look forward to your response, combined with confirmation that this matter is now closed.

    So, when you pop your clogs and have an outstanding parking ticket .... would you like your family to go through what you suggest when it can be pinched in the bud by Tesco ?

    I hardly think that parking scammers would be looking through the London Gazette for pretend debts.
    They have much more interesting things to do such as who can they scam next
