Currys PC World refusing a replacement camera after 3 months despite law on my side!

    You can't.

    If it came to it a judge would have to decide "on the balance of probabilities" (i.e. 51%) who he believed. It is nowhere near the criminal standard of proof (beyond a reasonable doubt).

    Have you tried emailing rather than going in store? I have found it to be a much easier way of getting better results. In store no they probably don't know the law, the same way I wouldn't expect the cashier in a super market to know the ins and outs of any laws relating to that...they are human!

    However...I'm not entirely sure how much of an inconvenience not having a camera really is, please remember a camera is a luxury item. It's not a necessity.

    Anyway what I really wanted to say was email them, I've found in the past quoting the law to them, if your correct and it does apply, does work and gets results.

    They were refusing to repair my laptop, until I quoted consumer rights, I got an apology and my laptop collected the following day. But only because I was using it correctly and accurately, very important or you end up in a bit of a hole. :)

    To be honest, if I was the OP, I would either send the camera to Canon myself under their warranty, or let Currys do it for me.
    Seems to me that after 3 months use, demanding a replacement is going to be flogging a dead horse.
    Can't you borrow a camera for the wedding?
    I make part of my living from photography, and I buy cameras from specialist camera suppliers myself rather than general electronics suppliers.
    You'd still only get a repair though.
  • S23 Consumer Rights Act 2015

    Right to repair or replacement

    (1)This section applies if the consumer has the right to repair or replacement (see section 19(3) and (4)).

    (2)If the consumer requires the trader to repair or replace the goods, the trader must—

    (a)do so within a reasonable time and without significant inconvenience to the consumer, and

    (b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).

    (3)The consumer cannot require the trader to repair or replace the goods if that remedy (the repair or the replacement)—

    (a)is impossible, or

    (b)is disproportionate compared to the other of those remedies.

    (4)Either of those remedies is disproportionate compared to the other if it imposes costs on the trader which, compared to those imposed by the other, are unreasonable, taking into account—

    (a)the value which the goods would have if they conformed to the contract,

    (b)the significance of the lack of conformity, and

    (c)whether the other remedy could be effected without significant inconvenience to the consumer.


    (5)Any question as to what is a reasonable time or significant inconvenience is to be determined taking account of—

    (a)the nature of the goods, and

    (b)the purpose for which the goods were acquired.

    (6)A consumer who requires or agrees to the repair of goods cannot require the trader to replace them, or exercise the short-term right to reject, without giving the trader a reasonable time to repair them (unless giving the trader that time would cause significant inconvenience to the consumer).

    (7)A consumer who requires or agrees to the replacement of goods cannot require the trader to repair them, or exercise the short-term right to reject, without giving the trader a reasonable time to replace them (unless giving the trader that time would cause significant inconvenience to the consumer).

    (8)In this Chapter, “repair” in relation to goods that do not conform to a contract, means making them conform.

    As already pointed out, a camera is a luxury item, so (for example) 3 weeks without a camera would not be as significantly inconvenient as 3 weeks without a fridge.

    I wouldn't have bothered quoting the CRA, the OP thinks she's knows all about the law as it is.

    OMG, I can't believe how deluded OP is. Surely after all of these replies you'd think they would accept the fact they're wrong. Good grief, some people!:rotfl:

    What's betting it won't be long before OP posts saying she has a replacement?!!! And possibly even £1000 compensation for the stress of it all!:D

    I never thought I would say this but I am actually beginning to feel sorry for Currys PC World.

    Loving this thread. Where it seems 99% of posters agree with Currys/PCWorld! Didn't think I'll ever see that on MSE

    If I were Currys I would screenshot it and use it as marketing!

    Nobody is having a go at your family. People are pointing out to you that somebody has told your Sister a whopping great lie which they have passed off as something that has happened to them. Simple as that!

    You don't seem to listen to all the people who have explained about these urban myths and seem to believe the story regardless!
