ID1 form help!!!

We have just sold our house and were about to exchange when the lawyers phoned me to say I need to complete an ID1 form.

I believe this is to remove the home rights notice I placed on the house (the house is in husband's name only, we've separated and are selling). They say they are representing him not me, so they nee this form.

Can any solicitor sign the form? Does it need to be a conveyancing solicitor?

I phoned a notary who said any solicitor should do it for £5-10! But everywhere I look it seems to be conveyancers only for £100 + vat!!!

Can anyone help me find someone to do this?

I'm in Birmingham if that helps

    You can go to the land registry and get it done there.

    Most solicitors won't do it for £5 because it isn't just a case of witnessing a signature, they are effectively saying that they have checked and are satisfied that you are who you say you are. It carries a risk for them that they could be accused of failing to check properly, or of being complicit in a fraud, if you turn out not to be the person you claim, and most take the view that it makes no sense to take that risk for £5 to help someone who is not their client. (If you instruct them to deal with it then they would normally have to open a file and do their own, normal anti-money laundering and ID checks, which is why they are quoting £100 +)

    I know that my solicitors have a blanket rule that they don't do ID1s. I don't know of any local solicitor who will.

    So while any solicitor *can* sign, most won't.

    If you've spoken to a notary, ask them to do it. If you look at the form, a notary is one of the types of person who is allowed to and if they think £5 is reasonable then ask them to do it at that cost.

    If you have a solicitor of your own, for example someone who has done other kinds of work for you and knows you personally, they *may* be prepared to do it for you, but many firms have a policy forbidding it.

    You can't get LR to verify ID1, then take it away to submit later.

    Are you doing the conveyancing yourself for your sale? Given your uncertainty, stop!

    If not, get your conveyancer to do ID1.
  • The house is my husband's, in his name only, so the conveyancers say they are working for him and not me, which is why I need to get the ID1 form done (I registered home rights on the property before we separated to protect my interest, I am having this removed as we have agreed equity split)

    Land registry said they can't do it like the other poster said because I'm not submitting the application simultaneously.

    Are you divorcing? If you are not on the deeds but simply registered matrimonial home rights then all you need to do is remove the notice, with an HR4.

    In fact your husband can do so by sending the form with a copy of the decree absolute or the court order or signed release from you.

    An ID1 form isn't required.

  • we will be divorcing but not for a long time.

    I have the HR4, it was sent to me by he conveyancers. I am really confused about why they need the ID1, they just keep telling me it's because they are representing my husband and not me? The house is in his name only, I just have the home rights, which I have agreed to remove.

    I'd suggest asking them to clarify things again. If you are not a party to the disposition e.g. Transfer, discharge, charge, lease then we should not need any certification re your ID

    The solicitors may have their own ID requirements and therefore use our form ID1 to achieve this. They may for example want this as you are signing a release letter re the Mat Homes Notice but only they can confirm

    If that is the case then see if they are happy for you to come in with ID evidence and sign the release in their presence (ex to be included?)

    I suspect they want the ID1 for own purposes

  • AFAIK I should not be a party to it, their offices are 4 hours away from me though (we used in house conveyancers with the online estate agent)

    I have provided them with my passport and proof of address when I filled in the property information form (I thought as I was living there, I ought to be on the form but I was wrong)
  • Just called a solicitors firm and they said they can do it for me for £5, fingers crossed!
  • Looking for one and cant find one cheaper the 60quid!
  • Considering the last post on this thread was nearly a year ago and they haven't posted in any thread since the 19th of Feb last year I doubt they are going to tell you.
