Yes but they must give you opportunity to use the leave.
So just ask them when you can use it.0 -

And in my organisation when you leave your pay is adjusted according to what annual leave you have taken. If you decide not to return to work it is a payroll/hr hassle anyway as they will reclaim some of your maternity pay so your be likely to be sent an invoice for overpayment.
But couldn't you take 12 months less holiday entitlement as mat leave (if that makes sense) and then take your holiday entitlement as holiday at the end of your mat leave .
You'd have the same length of time but with extra pay (as the holiday pay would be at your normal rate rather than at the maternity level0 -
An employer cannot, AFAIK, prevent you carrying over leave accrued while you are on maternity leave.startingout2016 wrote: »i am also not allowed to carry holiday over and they dont pay for holiday not taken.

Yep you can do that as one option- obviously there's lots of options about length of mat leave and use of annual leave, and lots of things to consider such as pay, time with baby, pattern of work on return etc.gettingtheresometime wrote: »But couldn't you take 12 months less holiday entitlement as mat leave (if that makes sense) and then take your holiday entitlement as holiday at the end of your mat leave .

Yep, that's my understanding too. And the link I posted on the previous page (and everything else I have found online) supports that. I'm a member of a union, and it's something I've considered seeking guidance onn, although I'm just waiting on some responses to queries with my hr.0
