Maternity leave/ holiday question

Question on using holiday entitlement prior to starting maternity leave…
Holiday runs 1ST May – 31st April.
Due date is 7th June.
I am planning on starting maternity leave on 7th June and using my holiday entitlement up in full before that to start leave early.
I get 28 days holiday per year including bank holidays.
I am confused as to if I remove bank holidays from my entitlement or if that will still be included as effectively I can’t be off on holiday and off on maternity leave at the same time?
In which case I calculate that I would take 27days starting from 1st May, taking me up to 6th June. Maternity leave would then start 7th June and I would be left with 1 left over day to take at the end of maternity.
Is that right?
Thank you

As someone about to go on maternity leave this will depend on your employer. I get mine as days entitlement to just use as needed, however a friend gets the payment for the bank hols as opposed to the days themselves. Check with your HR department to be sure.Officially Mrs B as of March 2013
TTC since Apr 2015, baby B born March 20170 -
I work for a relatively small company and they dont know!
They have said they will ask their accountant...

Depends what your maternity policy says. My understanding is that they don't have to include the bank holidays, but my employer does specify that they do include them.
As cat says ask HR, allthough my experience of hr has not been helpful- when my manager asked about carrying over leave and when it has to be taken the maternity lead said my management are generous for allowing me to carry over more than 5 days! Despite the law and the policy saying I can carry it over. My due date is May and our leave year runs April- April so like you I can't physically take all of it prior to mat leave.
I've found this website helpful https://www.equalityhumanrights.com/en/managing-pregnancy-and-maternity-workplace/faqs-employees/during-maternity-leave-leave0 -
You are entitled to 5.6 weeks leave per year. (just ignore the fact their bank holidays for now)startingout2016 wrote: »Question on using holiday entitlement prior to starting maternity leave…

Your employer is entitled to tell you when you can take A/L (so don't be surprised if your leave is not authorised)
But you continue to accrue paid holiday time so you can come back to / or be paid leave, after your maternity0 -
5.6 weeks seems a lot. Having done the holiday entitlement calculator on the government website it says i'm entitled to 28 days0

5 days in a typical working week
5x 5 = 25
5x 0.6 = 3
total = 28
The minimum by law is 5.6 weeks. (if you worked part time 2 days a week, you'd get 11.2 days holiday per year)0 -
Ahh, I see, so that all makes sense so long as my employer agrees to grant the holiday taken at the beginning and if they include bank holidays in the mix.0

Indeed, when an employer says - including bank holiday - all they mean is that 8 (typically, sometimes 7/9 - as A/L resets sometimes in January, sometimes in April etc) of your holiday days must be taken on those dates.0 -
Thank you

Out of interest, is there a reason why you want to use it all up before you have the baby? Every pregnant woman I've known tags their accrued holiday onto the end of their maternity leave to spend more paid time at home with their new baby.0
