Talkmobile financial issue

Hi guys,

To cut the long story short, I had a talkmobile contract about 4 years ago, contract that I have stopped to pay.
Eventually the contract went default on my credit file.
Now, I am trying to pay up all my debts and I came to this issue. Whenever I go on experian, and click on the default, it tells me its talkmobile ltd and gives me the address where I should write them.
Today I called them and the lady on the phone, after "dubbleling checking" told me that I don`t have any debts with them. I asked to talk to one of her managers as it was impossible to understand her and probably I will receive a phone call from him/her within today, to confirm that I don`t have any debts with talk mobile.
What happens now, if they send me a letter home stating that I don`t have any debts with them, am I right to get in touch with experian to cancel the default on my account ?

What do I do now, if they say I don`t have any debts with them ?

    If you receive a letter from Talk Mobile specifying clearly that you have no debts with them then you need to write back to them (Talk Mobile) and ask them to remove the default. Only the company who applied the default can remove it. Once you have received a letter back from Talk Mobile confirming that they have removed the default, only then should you contact Experian/Equifax/Call Credit and ask them to update their records. You yourself cannot cancel a default.

    I suspect however that your actual debt has been passed to a debt collecting agency and if you do receive a letter from Talk Mobile saying you have no debt with them, that when you write to ask them to remove the default, they will comeback with saying the account has been sold etc.

    The moment you stopped repaying the contract to TalkMobile, they would have tried their usual avenues of trying to contact you to get you to bring your account back to order. Once all these attempts failed, they instructed a debt collecting agency who then tried the same methods to contact you to pay the money you owed and once they too couldn't contact you, they issued you with a default.

    Defaults last for 6 years from the date applied. A lot of companies sell their debts on so I'm not surprised Talk Mobile have no records of your debt.

    From what I have seen on the experian website, if the debt has been passed to a debt collection agency, you find the name of the debt collection agency, but in this case, there no other name than Talkmobile. Ok, I admit my fault and I would like to pay the debt, but where do I pay it ?
    Or I just play stupid and ask them to remove the default ?

    If after you speak to the manager today and they confirm that you have no debt with Talk Mobile then you need to ask them to put this in writing and send you a letter stating as such.

    If the debt hasn't been sold onto a debt collector and it was definitely Talk Mobile that applied the default, then chances are because the debt is so old they may have moved it off their system and onto a back system accessed by a different department.

    It's why it's so important you need to get it in writing that you owe them nothing and then you need to write to them and send them a copy of the letter they have sent you and a copy of your credit report and ask them to remove the default.

    I suspect however that the phone call today will probably reveal that they have found your debt and if you wanted to have the default marked as 'satisfied' you would need to pay the balance to Talk Mobile. Note however that this won't remove the default off your files, it will still remain for the 6 years since the date it was applied.

    Do you have any old account numbers/phone numbers etc. that could help identify your account details?

    Whoever you speak to today won't be able to remove the default so no point 'playing stupid'. It will be a whole separate department that deals with credit reporting, hence why I said that if you get it in writing that there is no debt that it is them that you would need to write to in order to get them to remove the default.

    Sorry for the late reply. I spoke again with the customer services today, gave them the address where the default shows, they told me that for sure I don``t have any debt with them, but it will take a little bit of time to "investigate" which points to what you said above.
    In the same time, I asked them to send me a letter at the new address stating that I don`t have any debts and hopefully they will do that.
    After I receive the letter I will see what it needs to be done.
    Hopefully they forgot about it and it has been erased from their system :))
    Anyone knows a good hacker (maybe the data that they had has been deleted by the hackers in the latest attacks, fingers crossed).
    I had 3 defaults with on my account on Exerian, 2 have been taking care of them, payed them in ful, the only one remaining is this one.
    Is there any way (and I mean a legal way) to remove those defaults from my account? I am trying to get a loan to get a car but I don`t want to go to the sharks and borrow from them with stupid APR`s ?

    When you say you had a contract with talk mobile and you stopped paying, it sounds to me as though the default is justified (despite what their initial investigations are saying at the moment). Can't see any of the defaults being removed unfortunately.

    It`s turning to be a nightmare. I am not saying the default is not justified.
    Just received a phone call from the manager from Talkmmobile. It looks like I had a debt with them but it has been written off, they said that the debt must been sold to Fredrickson. Called them and it took them 45 minutes to find me in their system and surpise, I am not in their system.
    Fredrickson told me to call Lowell, which I did and again surprise, I am not in their system anymore other than 2 debts that they have been cleared.
    I am being told by talkmobile to call carphone warehouse to find out which was the debt colletion agency that they worked with in 2013 (when the default was placed). I can`t call caprhone warehouse unless I buy somethiing from them, as the only option to talk to them was to buy something.
    Yes, I wanna pay my debt, but WHERE ?

    Nightmare....this should be a lesson well learnt !!!

    You do understand that defaults remain on your credit files for 6 years from the date placed?

    Even if your defaults are marked as 'satisfied' because you have now paid them, you have slim to none chance of getting a loan from anyone other than from subprime lenders with extortionate APRs. You may have to rethink your strategy re obtaining a loan, at least until your defaults have fallen off your files.

    The only legal way to remove defaults is if they were placed incorrectly in the first place, or if you negotiated a removal with a debt collecting agency before clearing the balance.

    What are the dates of ALL your defaults?

    OK, so the defaults will all be 4 years old later on in this year. This works in your favour as the older the default, some companies will disregard them due to the age.

    Have you tried your own bank first re a loan? They will know your financial history and should be your first port of call.
