High view Parking Sutton-in-Ashfield

Just received a charge notice from highview parking for their client the broad centre Sutton in ashfield.
Apparently they do not have evidence of sufficient parking payment on the 9/01.
I actually recall the date in question and did pay the £1 Parking fee. BUT...The parking meter does not have a light on and I believe I keyed in the wrong registration number. I wasn't alone, another guy had the same problem. The keypad doesn't even glow up...
Do I ignore the letter or do I respond...??

Any help would be wonderful.

    easy

read and follow the advice by CM in the NEWBIES sticky thread , using the appropriate template (there are only 2 as there are 2 trade bodies)

should be easy enough to beat, although it may be on legal arguments like "frustration of contract"

start with the template after reading that thread (above this one)
  • Thanks for the reply.
However I feel that I could challenge them regarding the inadequate lighting at night. It was really pitch black and just couldn't see the keyboard
I just feel the template in question doesn't apply to myself. Or just do I follow that avenue anyway?.

    Just really confused.

follow the tried and tested path we are telling you

if they refuse the appeal, your POPLA appeal will include signage and other legal arguments , which you would know IF you had read that NEWBIES sticky thread

ie:- you are giving them a chance to cancel at the stage 1 negotiations , before unleasing the nuclear weapons at stage 2 (which for BPA members is POPLA)

why make it easy for them ? they are the ones demanding money with menaces for a speculative invoice due to poor or inadequate unlit signage

keep your ammo dry for popla, we know what we are doing , you dont , ergo , you do as you are told , lol ;)

come back and report the cancellation at stage 1 , or when you get your POPLA code, in which case revisit that NEWBIES sticky thread again for the popla draft appeal

the BPA template applies to everyone dealing with a BPA member, regardless, which is why its there and why it has those words in it (it could not be simpler as its copy and paste)

It does apply, but you could add that the signs are unlit so *the driver* could not see any terms or keyboard.

However, the reason for the template is to stop people like yourself blowing 4 toes off with an appeal that says ''I just couldn't see the keyboard I believe I keyed in the wrong registration number. I wasn't alone, another guy had the same problem.''

(eeek - NO - never give away the driver's ID to Highview!!).

Stick with the template; do NOT respond if they ask who was driving.

hi ive just quickly read your replies and anyone please help me with finding the newbees thread that you are all talking about. I don't use this site often so if its possible could someone please post me the link direct to the info I need.
received this letter today but the parking occurred on the 19th jan 2017 so I only have about 10 days left according to this letter.
I believe I paid to park and if I also believe but will check that the car parking is for 2 hours once the £1 has been paid. the car park fee was refunded in one of the shops in the car park area so I don't believe that the charge notice is correct but I doubt there is any proof of this. any help would be much appreciated. thanks nic

Isn't it clear enough in my signature under every post I make, where I tell everyone how to find the NEWBIES thread?

I wasn't being rude (just direct, we do this for free and it can be very wearing) and apologise if you thought so. Genuinely - good luck with your operation.

  • Thanks for the great reply.
I have just found an article from 2013. Where West norfolk council backed down on the car registration meter system during winter months because of poor lighting and people inputting the wrong registration number..
Would this apply to myself if the appeal fails?
