Ask them who contracted the parking firm then because it's 99% always the managing agents. if they did, they are liable for the actions of their agents, can certainly cancel these fake PCNs and can be sued and/or their site boycotted or charged to attend due to the scumbag protection racketeers they've allowed on site.
Stop believing what you are being told by the agents who almost certainly contracted this bunch. IMHO you need to be far more proactive and angry about this situation and ask the next obvious question each time.
THEM: 'It's nothing to do with us'.
YOU: 'Who is it to do with, then?'
THEM: 'You will have to deal with the parking firm'.
YOU: 'So who actually contracted the parking firm, or are they there without permission?'
THEM: 'Well we gave them permission and signed a contract, but the parking regime is their remit and there is nothing we can do'.
YOU: 'I have news for you - they are your contractors then, you've finally admitted it. You remain liable for their actions and it is likely to be a case of derogation from grant to try to 'fine' residents and their visitors, because of existing easements or rights of way. There have been court cases regarding this sort of unfair action by managing agents, disregarding residents rights in residential car parks. Not only that, we were invited on site by YOU.
Get this cancelled NOW and get our vehicles added to an 'exempt list' for your sites immediately. As you know, our engineer was carrying out repairs for you so this is your liability and if we are sued, we will sue you. And we will not do business for you unless you exempt our vehicles or agree to pay any PCN for us. Appointing a rogue parking firm in a residential car park is a big mistake.'PRIVATE 'PCN'? That is all very well CM, but some landlords, myself included, are very reluctant to have their tenants contact the Management Agents. It is the landlord who signs the ATA, and it is the landlord who is responsible for the proper conduct of the tenancy.You never know how far you can go until you go too far.0
