The MIL representative was very pleasant and was happy to chat outside. He confessed he wasn't surprised to lose as he loses every MIL case he goes to

    Given the location and the Claimant I suspect that this is one and the same fellow who has represented MIL in numerous other cases in that neck of the woods. I suspect this is the same chap who, at the first MIL hearing we came across him at, boasted that he had never lost a car parking case.

    That said the majority of MIL cases are default wins - which just goes to show how many people continue to be frightened off when a claim flops onto the doormat. It is a shame that more of these people didn't come to realise that MIL can be defeated and although it sometimes has the feel of a game of "Chicken" rarely now do forum-assisted and defended cases end up at hearings.

    This means that MIL can easily afford to lose the odd case here or there. Their problem is that sooner or later they are going to p*ss off the wrong judge and at that point the gravy-train will come to a shuddering halt.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    In the light of this, and other similar cases involving MIL and the like, and other parking related companies that like to misrepresent and obfuscate the law......

    I think it is high time that, with every claim form sent out by MCOL, a (mandatory) information leaflet is enclosed, explaining in simple terms what the law is, that costs are strictly limited, and how one can get a CCJ and a bad credit rating (i.e. by losing, then not paying within the allowed time). i.e. you will not get a CCJ if you lose and pay up.

    People should not have to come to a forum like this to get that information!

    This could be done in a similar way to the "Key Facts" leaflet sent with loan application papers for example, as is, AIUI, compulsory to comply with financial services legislation.

    This may perhaps reassure people, and lead to more claims being defended instead of people just paying up out of fear.

    Can anyone who has received a claim recently comment on what is sent out with the claim form?

    For the majority I suspect a toilet roll would be a good inclusion! :)

    There is only so much you can do to protect people from being conned.

    All the information they need is out there, If they cannot be bothered to put in the hours, then they cannot expect to get the result they would like.

    There are far worse things that can happen to them than a PCN, being ripped off by an insurance company who reject a valid claim, having a travel company go bust while you are on holiday, being sold unnecessaty ppi, paying 4,000+ percent interest to a payday loan company, being conned into selling your gold at a quarter of spot. It is a minefield out there.
    You never know how far you can go until you go too far.

    The claim form which includes a means questionnaire together with details of agencies such as the National Debtline etc.

    Why stop at including an explanatory leaflet at the claim stage why doesn't the BPA/POPLA include an explanation to the effect that mitigation is likely to count for precisely zilch?

    We should remember that out alleged betters want a nannying society but not one that prevents them from continuing to fleece the unfortunates who have never been taught how to contain their emotions while they deal with things or what delayed gratification is about. Everything now comes down to money.
