PIP assessment results back, should I appeal?

    Ok, so someone phoned me up about it after I requested that, and now I have four days to proceed to the next stage, whereby I must state which parts of the decision I disagree with.

    I got 11 points so as 1 short of enhanced rate for care, and now lose £100 per month on mobility. Should I try and get another point for care? Can they turn around and take it all off me if I go through with it again? The fact I came so close makes it tempting given I lost that money, but I don't want to risk losing everything if they then turn around and give me less than eight points. Which seems spiteful but then these cuts are in essence, being designed to save money first and foremost.

    Anyone got any suggestions?

    As far as mobility is concerned, there are only two activities. If you can 'take walks by yourself' most days, then you will be awarded 0 points for Moving Around, presumably you got 4 points under Planning and following journeys, because you need "prompting to be able to undertake any journey to avoid overwhelming psychological distress". The fact that these walks are in 'local empty countryside areas' does not appear to be relevant; PIP assessments are based on your functional ability. But I am guessing here.

    In truth only you, can really answer the question of whether any appeal would give you more money. You have to work your way through the descriptors and honestly decide what it is you can and cannot do, and identify where it is you think the error (if any) has been made.

    You need to go through the descriptors and see whether you think the assessment was correct.

    DLA and PIP are totally different benefits with different descriptors.

    People who were awarded low mobility for DLA often find their mobility award has been taken away if they do not actually have any difficulties with the physical action of walking.

    It is entirely up to you what you do. Have you got time to get advice from CAB/welfare worker?

    And yes, they look at the whole award again and may reduce it. Meeting the descriptors is the key and having medical evidence to back up that descriptor.

    Where you go for your walks is not relevant to the claim. They are interested in the distance you can walk. Only you can decide whether or not to appeal, although on the face of it there seems little likelihood of success.
    If you appeal the entire claim will be looked at so it is possible that you would be awarded fewer points after reconsideration. Likelihood of that happening is low.

    So what about he fact that I just missed out on enhanced rate by one point? Should I try and go for it on that basis?

    How can anyone with mental health issues get mobility payments then, if you say you can walk more than 200m or whatever? The other criteria only add up to 4 points.

    You need to look the all the descriptors and see where you think you should have scored more points.

    Planning and following a journey take a look at the descriptors and points.

    1) Read post 7.

    2) Then go carefully through the DL activities, and check if you think a minimum of 12 points should have been awarded.

    3) If you can (within the time limits) seek guidance from your local CAB / advice agency.

    4) Only if you think you can make a persuasive case at tribunal for the Enhanced DL award, and can get relevant medical evidence to back this up, is an appeal worth considering.

  • One of my friend didn't got pip back so I got supplementary payments his still apeal it at the moment but he have to go to a hearing wich means they gonna be decide he going to get it or not but if hes not getting it back I. Still entitled to suplimentary payments or they taking it from me?

    How long it’s paid for
    You’ll get the WSP for up to one year. It’ll stop if:
    you qualify for CA or IS again (eg the person you care for is awarded the daily living component of PIP, or you start caring for someone else)
    the person you’re caring for has appealed the decision not to award them the PIP daily living component, and has withdrawn or lost their appeal
    the person you care for has been awarded only the PIP mobility element on reassessment and this stops
    you or the person you care for goes into hospital, a care home (unless privately funded) or prison - payment will stop after 28 days
    the person you’re caring for dies - payment will stop after 8 weeks.
    No WSPs will be made after 31 March 2020.
    If the person you care for starts getting the daily living component of PIP, you won’t get your CA or extra amount automatically. You’ll have to apply for it again.
