This happened a month ago, a few days after Christmas. It's not a main road so I doubt it was inspected regularly as it would be an impossible task for any council to regularly inspect all roads.

It is a fairly trivial task to have an inspection schedule for all the roads that they manage.

Surely the repair is evidence that they did inspect it!

You want to know how long ago the repair was made or the last time that road was inspected whichever was latest. If the timeframe is "reasonable" given that it is not a main road, and you were the first person to report it they are not liable.

Which is why the classification of the road is taken into account in deciding what's a reasonable frequency of inspection.

Sorry, but as you've described the situation, you don't have a leg to stand on with a claim.

    .
They said they repaired it in response to me reporting it and the damage it caused.

Thanks for the link. Will follow the step by step guide as I'm £600 out of pocket and I have nothing to lose.

The garage our car was towed to has recorded the damage plus we have the 2 damaged tyres in our garage as we were told we might need them in order to claim if the council asks for evidence of damage.

This is the repair I'm talking about

No they say all roads in the LA are inspected regularly so therefore they are not liable. But this pot hole was long (at least a metre) and there was evidence of a previous repair.
Previous to you hitting it? Then they had repaired it before you hit it, and must have inspected it before you hit it. How long before is what counts.

By all means claim, anything is a bonus, but don't spend money on solicitors as you are unlikely to get it back

They may well have repaired it last winter, or the winter before. The fact that that repair's failed does not necessarily make them liable for this repair.

I had £650 of damage from a major pothole on a very busy roundabout. Went through the above and got nothing - as long as they have inspected the road on "schedule" their !!!!!! are covered.

Even when it is clear that a large pothole could not possibly (under the balance of probabilities) have appeared in the space of two weeks?

Except it can. Once a previous repair has started to break up, it can expand and develop VERY rapidly, especially with heavy morning frosts.
