Volkswagen won't remove default.

In AUGUST 2014, I was visited by a repossession company Anglian to inform me that my car was to be uplifted. Why? I had no idea!! I went straight to the Clydesdale Bank to find Volkswagen Financial Services had stopped taking direct debit payments for my car. After phone calls to VW and more visits to the bank, I was advised by VW that my name on my DD had changed to X ??? My DD was still open and active for VW to take their payments.
In OCTOBER 2013 myself and my fianc!e set up a joint account to specifically pay all our DDs. We checked our first bank statement in November 2013 and ALL DD payments were made correctly including mine and my fianc!es VW DDs.
Clydesdale Bank branch and head office assured me that the joint account and all DDs had been set up correctly and the error had not been made by them. They advised me to take legal action against VW. VW denied this and also denied taking the first payment from the new joint account. (It's on my statement)
In MARCH 2013 we moved into our new home as my fianc!e was expecting our first baby. I wrote to every company to change our address details, somehow VW never received this information. They did try and contact me by phone in FEB 2014. They called ME insisting I answer personal security questions before they would talk to me, I was not comfortable giving out my details to someone calling me. I feel if VW had told me it was about my DD payments it could all have been rectified there and then.
VW agreed for me to pay the lump some of monies accrued in my account due to them not taking the payments and complete my monthly payments as per the original agreement till AUGUST 2015 but will not remove the default on my account.
My credit rating has now been badly affected due to this default and I feel we are being punished for someone else's error. I hope you can assist me on hopefully getting it removed.
My current mortgage fixed rate came to an end in 2015 and are now having to pay an massive increase on the variable rate.
This ongoing situation has caused us so much stress, emotionally and financially. We have recently had our second baby, my fianc!e lost her job at the end of last year, we cannot get any credit or mortgage because of this default. we would be grateful of any help you could give us.

    You didn't notice that the money wasn't being collected and failed to receive any of the overdue letter correspondence. In the best part of a year. Hardly surprising that VW are taking a hard line. There appears to be something missing from the story.

    When VW finance called you could have contacted them to ask what was the phone call for, might have gone some way to alleviate the problem.

    Unfortunatly I would say this default is accurate. I can't see you getting this removed.

    In Feb 2014, they tried to call you, you refused to talk to them, surely this was the time to think "perhaps I should call them and see if that was a legit call and what they wanted".

    If you just hide from them, it's not surprising.

    In terms of your mortgage, who is it with, Clydesdale also?
  • Because I had checked the joint account and all was fine for the first month I didn't check it again, that was the whole point of it, plenty money to pay all my direct debits.
    I honestly thought it was a sales call as I recieve lots, windows, PPI, solar etc I never give out personal details, especially if it's someone calling me!

    The problem clearly lies with who changed my name to X

    You could try a subject access request to find out who changed it I guess?

    Your default is now settled which will help, it's not impossible to re-mortgage with a default btw - You need to speak to your mortgage lender (who many not even do a credit check!) and an independent mortgage broker.

    You can also escalate your complaint using VWF's complaints process including going to the ombudsman eventually. I guess the argument is that as they changed your name then any re-directed post was not processed by Royal Mail.

    In future always keep an eye on all your DD's - don't assume they have left your account because then you are entrusting your credit files to someone else making potential errors which as you can see will affect you. I'm super paranoid after I had an issue with my pet insurance pulling this on me once. Thankfully I noticed before it became an issue - but although everything had been set up (the DD registered on my DD's list) they never took it. Which means in effect my policy was pretty much void.
