I was a bit silly and posted this at the end of an old thread. This is basically a repeat of that post.
I received a PCN from ES, on their PCN, it states to appeal to IAS. I have read that IAS always reject appeals, so I requested a POPLA reference from them. 20 days after they received that request (sent recorded), they have not issued a POPLA reference, but merely upped the charge. Are they not covered under POPLA, but by IAS only?

Only members if the BPA use PoPLA.You never know how far you can go until you go too far.0

Is it worth appealing to IAS as I am now out of the 21 day time period (ES delayed sending a response to my letter requesting an appeal reference number for 20 days) and IAS will charge £15 for the privilege of appeal.
Also, it does say that any resolution is subsequently binding, so perhaps it would be best not to appeal to them and wait for a small claims hearing?

Up to you, I would appeal, others here disagree. Result is not binding on you, only PPC.

I saw your case on pepipoo and appeals are hard to win unless you can show that the Judge ignored vital evidence or erred on a matter of law.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
