I wonder if you could advise me on what to do pls. My partner & I parked the car in Morrisons last October. As the registered keeper, I got a Penalty Charge of £100 in the post from Parking Eye in Nov. Two weeks later in mid-Dec, a Letter Before County Court Claim was sent to me requesting for the said £100 to be paid within 14 days. Last Friday, I got a letter from DRP asking for a payment of £160 to be paid by next week 31st Jan 2017. The letter says that if not paid by the 31st of Jan, they will recommend Parking Eye to take court action against me.
Could you please advise me on what to do as I haven't made any appeals.

    point of order, NOBODY received a PENALTY CHARGE Notice , it was a PARKING Charge Notice (PCN)

    ignore DRP but bear in mind that it is highly likely that the KEEPER will receive an MCOL in the post this year , from Northampton centre, on behalf of PE

    tell whoever parked the car not to use private car parks for their own purposes, unless its as patrons of the retailer (s) - this is why they employ parking companies , to stop bilkers (sorry to say but it needs pointing out)

    if no appeals were done , its too late to appeal now

    if nobody used Morrissons , then you cannot complain to them either

    Once I get the MCOL, would I still be given the opportunity to pay? I am trying to avoid any court hearing or getting a CCJ.

    a CCJ only happens if it goes to court , you lost , then you did not pay the judgment within the time specified by the judge , usually within 28 days

    so pay promptly if you lose and no CCJ

    the claim can be paid , IN FULL , any time up until the court steps , and may vary , also a settlement can be negotiated up until you go through the door into the judges chambers I believe

    study the MCOL process to see what happens and when , also study the NEWBIES sticky thread too

    PE issue about 25 to 30 thousand court claims per annum , so this will more than likely happen if you IGNORE their invoice (the pcn and demands for payment)

    so no CCJ as long as its settled before the end of the judgment (the expiry date on the court judgment - issued by the judge or the court)

    I think Morrisons dislike their contract with PE so much that they've even cancelled for non customers.

    @OP - if you (or any of the car's occupants) are regular M's customers, I would email M's, attaching any till receipts and/or bank/cc statements or M's 'More' loyalty card number to prove genuine patronage.

    Yes, I know it says 'do not reply', but it works and gets cancellations. You've nothing to lose, even if they say 'no', you're in no worse a position than you are now. It certainly won't do any harm to you.

    Are you sure it was an LBC you got in December? That doesn't fit the normal process. It would have been far too early in the cycle to start the LBC process, and then to proceed to debt collectors doesn't make sense.

    The letter I got in mid-December has LETTER BEFORE COUNTY COURT CLAIM boldly written on it. The DRP letter arrived about a month after it about a week ago.

    So they've gone back from LBCCC, moving backwards to 'debt recovery' drivel letters - I wonder if M's and PE have come to an agreement?

    We are now seeing M's ask for a receipt before cancelling, in more thean one case, whereas they used to cancel ALL of them because they were p'eed off about PE.

    And here we have PE 'not suing' when that would have been the next step after the LBCCC.

    I wonder if PE have pulled back a bit from suing M's customers in return for M's not being so quick to cancel? We'll see.

    So, send a complaint to M's using that 'donotreply' email (no other) - DO NOT SAY WHY YOU PARKED THERE AND PLEASE EDIT YOUR FIRST POST!

    If you have a Match & More card or other M's receipts from family (or bank statements from family) which show you are regular M's shoppers on other days, attach them to your complaint email to prove genuine family patronage of M's and encourage them to cancel it now. Is that M's a pay & display car park or one where they should have put in their VRN instore, and didn't?

    As for DRP, ignore them.

    Where did I say you HAD to have receipts? I said:
    If you have a Match & More card or other M's receipts from family (or bank statements from family)
    What about colleagues who might have a Match & More card or receipts and *might* have been with you that day...? Proof of patronage makes it easier that's all, stop being a victim.

    No. Even people who lose at a hearing pay about £150 - £175 so please just do as advised and do not think this *has* to be paid at £160. Look, here is the proof, read this one:

    In post #8 she shows her claim form (same as your situation) and - it is for...£160! And she got it cancelled, albeit her case was unusual.

    If people just grew a pair and didn't roll over and pay these fake PCNs, there would be no private parking 'industry'.
