If Diesel both allow you to return an item you buy in store, and don't print the size on in-store receipts, there is a work-around. Go to a store, buy the correct size, then return wrong-sized pair a week later using the newer receipt.

The size may not be there but the product codes will be different

I'd be inclined to phone the nearest branch and ask the manager if it would be possible to exchange them for a credit note. You never know the manager may have a bit of discretion.
Why would a branch voluntarily agree to take the hit on an internet sale??

That's unlikely, actually. A pair of jeans bought on the internet from the same firm will be barcoded identically to stock purchased in store.

I love it how you just really casually advise OP to make a fraudulent return! Though in fairness, it isn't a bad idea if you are that way inclined..

If you don't ask you don't get, it's worth a try.

The sensible thing would be for the branch to accept a swap of sizes as long as the OP buys something else in there. That way they get another sale and the OP is happy. (All assumes the branch have enough stock, and their stock system allows them to do this).

But the barcode will be different depending on the size, so this wouldn't work if they want to change from, say, a 32 waist to a 34.

    Fraud Act 2006:

    2 Fraud by false representation
    (1) A person is in breach of this section if he—
    (a) dishonestly makes a false representation, and
    (b) intends, by making the representation—
    (i) to make a gain for himself or another, or
(ii) to cause loss to another or to expose another to a risk of loss.

    5 “Gain” and “loss”
    (2) “Gain” and “loss”—
    (a) extend only to gain or loss in money or other property;

As my suggestion involved a swap of sizes, assuming both sizes are priced the same there is no net gain or loss for either party.

Are you sure about that? I'm not aware of retailers who barcode differently for different sizes, they just have one code for the style. Hence when online shopping the delivery note has one column for the product code then a second column for the size. Although I'd have to admit I've not compared two items side by side to verify this.

The shop will lose out on the pair of jeans that they are entitled to receive, as per the terms of the contract.

I agree the barcodes are different for various sizes otherwise there would be no way to differentiate them in the warehouse and for ordering purposes.

My point was that the same codes would be used across the whole firm whether internet or in store.
