car write off

Hello.

12 weeks ago i was involved in a 3 car accident. A tesco delivery van rear ended a lady behind me with such force that she hit the car in front of her (me).

Tesco driven accepted liability at the scene.

I have only third party fire and theif insurance. I didnt get any offers from eithe party. It was my first accident i didnt know any better so i went with commercial legal, accident managment company.

They took my car away. Provided me with a small credit hire car.
3 days later they informed me that my car was a write off and said they will contact partyvat fault for payment.

16 days after i got the hire car i returned it since i didnt need a car anymore.

It been 12 weeks now no update. I call them every week to hear the same story: third party is very slow to reply and cooperate. They assure me the will keep pushing.

I asked if my car is still being charged for storage they said no. However i cant trust them. Since taking my car away i havent heard from them or recieved any letters from them.

What can i do?? Im very stressed and really need they money for my car. How long can it take?
Im feeling very hopeless.
Anyone with similar experience?

how much do they value your car?? or how much would you value your car??

Tesco unfortunately.... look at their reviews for car insurance. You could make a complaint to your own insurers, assuming your claiming through your own insurers and they claim from Tesco

But this could mean you paying an excess and lose NCB until your insurers get refunded by Tesco

Are the accident management company via your insurers??

Insurance can move slower than icebergs. Took my parents 2 years to finally receive a settlement on a non fault claim.

The other partys insurance were just useless. They would stop replying until threats of court action. They they responded for a bit and then repeat...

If you now need a car again get back to your claim handler company and they will oblige

You need to get to the bottom of who is causing the problem here.

Speak to your accident management company, find out when they have made contact with the other side, what has been said, who they spoke to etc. Tell them you will be making contact with the other side to get this moving, if they start to clam up, make excuses about not giving telephone number, reference etc out (you may have this already), don't let them.

Then call the other side, ask whats happening, why no payment, have your company been in touch etc.

You may get nowhere with the other side, at least you'll know where the blockage is and can ask your accident management company to start moving with a bit more clout, but as forgotmyname has mentioned, you may have to go to court for this.

As an aside, why would you go TFP&T on a £5k car?? Comp is worth it with a car over £500 for the windscreen cover alone.

These days you can normally get comp cover cheaper than tpft on any value car.

(Some insurers reduce the premium for big voluntary excess on comp policies - eg £1000, effectively meaning you get cheaper premium than tpft cover on a £500 car that you'd never want to make a claim for if you were to blame )

you can still go through your own insurance as it is a non fault claim. You cannot go through your insurance if you caused the accident AND want to get back the value of the car.

A lot insurers give you the value first and claim it from the fault party.

Another thought, do YOUR insurers know about the accident?

No insurer deals with any claim from their policyholder (irrespective of blame) with a tpft policy!

It's a TPF&T policy? Unless the OP has BTE legal cover.
