You don't only have 14 days, you have 28 days to appeal and the NEWBIES thread tells you to do this online, in the name of the registered keeper, not implying who was driving, on day 26. The reason why is explained in the sticky thread.

Use the template in the NEWBIES thread for BPA members and add a couple of lines stating that you have moved and your address for service of the POPLA code and any letters is:

    xx xxxx
    xxxxx
    xxxxx

Now, please go back and edit out from your first post, all mention of who might have PARKED in case a PPC reads this and if you end up defending this at small claims.

So if the house is freehold then you own the allocated parking bays (and most likely the land with paved stones leading to your house) and therefore, I presume, that is why you are not getting ticketed there and don't need a permit.

Where you got the PCN was on the electric car charging area, a totally different piece of land to the two mentioned above. I suspect this area is then considered common ground and under the "management" of UKPC. However the lease still says nothing of showing a permit although we do have the "Estate Regulations" clause to decipher.

Saying all that - at least you have a POPLA appeak not an IAS appeal so all being well with help from people like Coupon Mad you can get this stopped at POPLA.
However keep looking into the Lease etc. as that information might help with valuable information for the POPLA appeal.

Also worth a casual phone conversation with the MA to find out more about exactly what they have agreed with UKPC and also find out whether self-ticketing is going on here as you had no windscreen ticket so it could be a neighbor reported you?
  • Hi all,

I spoke to the management company and they contacted UKPC, UKPC said that I needed to send a appeal. However, in the time which the management company sent the email and I had received a reply, I had a second letter via the post now demanding £100.

What would you advise on the next steps?

    Thanks

How does this change the advice already given? It doesn't..

  • Thanks,

I picked up my post from parents, only to find a letter from a debt recovery agency (Debt Recovery Plus).

Is it too late to appeal, the delay was from the management company?

You must get in touch with the management agency and make them put a stop to the rogue parking company's actions.

Yes, too late to appeal but so what? Why do you want to reply to a DRPlus letter, when you've read the NEWBIES thread (post #4 of the sticky thread being ALL ABOUT ignoring Debt Recovery Plus) and no doubt you will have read other threads like this in the month since you posted:

Come back if UKPC try a small claim, which is no biggie. Please don't tell us about the same-old-same-old DRPlus & Zenith letters.

Concentrate on complaining/getting other residents to support getting the ex-clampers kicked out. They have no place in a residential car park.

Too late to appeal it, but its never too late to put them on notice that they must drop this parking charge immediately, and issue a full apology and re-assurances it wont happen again.
They will probably ignore and carry on, however it would be useful ammunition for you, should you decide to take action ( or defend yourself) to show that you have been reasonable and the behavior of the PPC is unreasonable to any court. Unreasonable behavior by the PPC opens up a few additional avenues for you

  • I've emailed the management company again stating they need to speak to the parking company and have this charge dropped. I'm a resident of the area and the parking company should be here to work with the residents. I have spoken to neighbours and they all say the parking company is a nightmare.

I was also thinking of responding to the DRP letter via Diasy post?

Half_way, how do I go by putting them on notice, if this done via the management company?

    Thanks,
    Sam.
