Hi just thought I'd add to the discussion, check with consumer advise but they told me recently when I had problems with a car dealer to reject the sale of the car, by doing this you can not use the car once the recorded delivery letter has been sent to the dealer, and also give the dealer 14 days to respond to the letter. I know this is a nightmare as you didn't buy the car to have it sat on the drive for 2 weeks.

OK, you've had some great advice so far, but I wanted to let you know I had a similar situation many years ago. I bought a used Astra that was fine on the test drive, but which had faulty front brakes when I took it away. Not quite sure what had happened in the week between test drive and me collecting it, but the result meant it was a frightening experience.

They grudgingly put the car on the rolling road to 'show' me (I'm female, and was 20 at the time) that the brakes were fine, even though they clearly weren't. They also had the MOT redone and it passed (don't quite know how but I suspect it was probably done by one of their mates). They didn't really want to do anything about the problem, even though I had bought a car that I couldn't use.

In the end I went to the CAB, who were really helpful and once I returned to the garage armed with the information (not to mention my dad!), they took the car back. They were extremely intimidating and if I'd been a girlie on my own I'm not sure that I would have managed to return the car. However, once I mentioned I would be speaking to Trading Standards if they didn't sort it out, they couldn't do enough to refund my money and take the car back. They weren't happy though.

Stick to your guns and don't be fobbed off. Contact CAB, Trading Standards, etc, etc. And don't forget, if the dealer is part of the VW franchise, contact VW. The car has to be fit for purpose - and this obviously means it has to be road-worthy.

I absolutely hate the way a lot of second hand car dealers conduct their business - I'm not tarring all with the same brush, and I know there are many out there who are really good, but as my Granddad was a mechanic, I got to hear about too many of them who were charlatans.

Apologies if I've repeated what has already been said...

    Good luck
    D.

I totally agree with you I was in the same position, my car is an automatic and it kept going into limp mode (all sorted now-fingers crossed ) but when I contacted trading standards and consumer rights they explained what my options were. To reject the sale of a car due to it being unroadworthy you are supposed to not use it from sending the recorded delivery letter to the salesman. I was lucky I got the fault sorted on mine but yours seems to have a few faults so I would definately go down the road of rejecting the sale. Who knows what else could go wrong with the car a couple of months down the line and then you will be without a car and certainly without any chance of getting a refund.

Out of interest how much did you pay for the car and how old is it?

I have my fingers crossed that everything works out ok for you.
