What options do I have?

Hi,

To be honest not sure what I can do.

I started to park on private land owned by Parking and Property Management Ltd.
I was given a PCN on my windscreen. I ignored this and continued to use the parking. I have since received 8 other PCN's dated between October and December.

I received some post through in different stages as the registered keeper claiming that this charge had not been paid and needed to be sorted. I ignored these and threw them in the bin. I then received a solicitors letter from Gladstones telling myself there was 1 PCN outstanding and they were now dealing with the matter.

I received a letter to claim letter afterwards which I then further ignored and threw away.

I have now received a claim form for this one outstanding PCN asking for fees now totalling to £220.00.

I have read through all of the threads. I have not kept any of the paperwork and realise this is a mistake.

I don't know what I can do from here. Please help me.

    read the court section of the NEWBIES sticky thread , and follow the instructions in there on defending the court claim (I assume its a court claim from Northampton ?)

    if you keep parking on private land without permission you can expect a lot more of these to arrive in the post - so get your head out of the sand, plus stop throwing away important paperwork too

    think of every parking event as costing you about £200 , there is obstinacy and sheer stupidity !!

    It won't be owned by them but managed.

    You're keen to see them in court
    I have now received a claim form for this one outstanding PCN asking for fees now totalling to £220.00.

    You're going to see them in court then. Expect them to send you up to 7 further claims as they milk you for all they can get.

    You need to Acknowledge Service. There is a link about that someone will add to help you

    Edit: As Redx says see the Newbie thread.

    What isn't in the Newbie thread is the suggestion to send a Subject Access Request for ALL the information they have on you. For £10 you will get all the details they have on all 8 events. Since you will need it all and since refusal will be frowned upon by Aunty DVLA and Uncle ICO, you'll get the information.

    Also am I treating you as stupid? Apologies if you think I am.

  • Apologies, yes managed by. I have already spoken with the Landowner who has told me has not dealings with the parking and contracted this out this company.

    I have already acknowledged service. Service date was the 11th of this month so active from my understanding from the 16th? I read somewhere 5 days from service date.

    Do I send the Subject Access Request to Gladstones or Parking and Property Management?

    I prefer the word ignorant. VERY IGNORANT :(

    What chance do I have?

    You are looking at the possibility of paying out over £2000 for this, time to take it seriously.
    You never know how far you can go until you go too far.

    I understand the mistake I have made. If I wasn't taking this seriously I wouldn't be pleading for help on this forum

    Please read the section in the NEWBIES thread first, telling you what to do. It is there to help you. It is headed 'Small Claim?' in post #1 and it tells you what happens when. What to do and when and how, with example defences linked.

    Come back when you have read some defences and completed the AOS on MCOL to buy yourself the month from the date on the claim form.

    Hi Coupon,

    Thank you for replying. I have read this thread and I am finding it difficult to find a defence that can relate to my situation. I will be using all possibilities and will spend some time going through this. I will then post a draft copy for proof checking.

    To note I have already completed the acknowledgement of service.

    Sorry I know you get a lot of questions all the time, this is tough for myself as there is so much information to gather and it is all starting to become one.

    You said you contacted the landowner, can you get a letter from them stating that they as principal have contracted the parking out to their agents: parking and property management limited, and they as principal do not support their agents taking this matter through the court system and wasting/using valuable court time
    From the Plain Language Commission:

    SAR goes to PPM. This is the address you use. If they don't cough up all the information for all the dates, have a word with the ICO.

    SAR's have a bite in them the PPC's have not cottoned onto yet.

    Also send a CPR 31.14 (https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part31#31.14) request for all pics of their signs ON THE DAY and the contract in place ON THE DAY. Be very specific as it will help later.

    Loads of examples on pepipoo. Show us your draft based on recent ones only (past 6 months, no older).
