Civil Enforcement Ltd County Court Business Centre - Help needed please

Hi there.

New to the forum, but have looked it up occasionally for advice. I was hoping to get some advice with a claim form I've recently received.

I'm not too sure what it relates to, I did have some PCN notices come through from Civil Enforcement Ltd but didn't respond. It relates to an occasion from January last year. I've just received a Claim Form from the County Court Business Centre in Northampton.

I have 14 days to reply but am genuinely unsure as to what I should do, as I really don't want to be dishing out over £300 to a PCN company.

Could anyone give me some pointers? Thanks in advance.

    Please read the NEWBIES FAQS sticky thread section in 'Small Claim?' Tells you what to do when and that you need to acknowledge service of the claim first to buy more time to write a defence.

    You can find CEL defences on here by searching the board for 'CEL defence'. We have never lost one v CEL, helped with loads in 2016; none even went to a hearing.

    A little more information would be of use, such as who's car park? Why the bricks got a ticket and so on

    Ah, understood, I'm going to read through that now and add a few details as needed.
    I can't remember exactly but I believe it may be in regards to parking at a hotel car park near Heathrow for about an hour. I went in to see my partner before he flew out of the country, but assumed he'd put the car against his room.

    So what happened when you got in touch with the hotel, and told them to cancel this charge levied by their agents?
    If you havent done that then you need to do so ASAP, remember the hotel is also liable for the actions of the parking company and they can tell them to cancel.
    If the hotel wont cancel then try and get it in writing from them that they do not agree to the parking charge issued to you by their agents (Civil enforcement) that would/should be fatal to any attempt at court .
    You could also use it as a stick to beat Civil enforcement ,as the principal ( the hotel) has stated they do not support Civil enforcement in levying this charge you require Civil enforcement to stop processing your data in accordance with the Data protection act.

    And if the Hotel wont play ball, then by all means have them joined to any court case that may appear and claim your costs against the hotel.

    Right, thanks for the advice so far everyone.
    I've had a read through some posts and the Newbie thread.

    So my plan of action at the moment would be to acknowledge the claim form, and then file a defence within 28 days? Not to put anything else across to them? I was planning on doing it online, it was issued on 13th Jan, so service date is 18th Jan. I would just acknowledge the form, make sure they have my right details and then prepare a defence. Is this correct?

    In regards to what happened, I believe (bearing in mind it was a while ago, I'm not sure if this is what it relates to) the car was parked at the hotel, and should have been assigned to a room, which it was not. This is something the hotel staff should have done as I was assured they'd been informed. Had several threatening letters sent before it's gone to the county court.

    Other than acknowledging the form, should I also then complain to the hotel? Once I can remember which one it is..

    Complain to the hotel and ask the manager what days he/she will be free to attend court as you will be calling them to your local one as a witness since they employed the scammers.

    You could also complain to the CEO and leave negative feedback on their social media page. Don't miss the court deadlines whilst doing this though.

    Right I'll get on trying to find out the hotel, cannot remember for the life of me.

    In regards to the process for the court, is that all I should do for now? Acknowledge, no other details, and prepare a defence to post here for review before sending?

    An update on this claim, as I contacted the hotel to complain, who informed me to complain to their head office who in turn sent me back to the hotel. I filed a complaint with the manager and the only response seems to be a 'particulars of claim' letter.

    is this something I should change my response and defence for, or should I carry on with acknowledging the claim and filing a defence before the 28 days are up?

    do not let your hotel complaint cause you to lose sight of defending this

    the hotal complaint is in parallel as you are hoping that the hotel will back you up , thereby meaning the landowner is on your side and that the PPC may have no locus standii in taking it to court

    your defence is paramount here , the rest is icing on your cake if they back you up
