    10 mins or 20 mins or even a 1hr , in this case the OP was not parking and reading signage , they (as per origional post) "never even left the car" , or took advantage of the generous 10 mins grace period that was applicable for time to read the signage

    a 16 min park up (as admitted) is 16 mins on private property without paying the parking fee

    I have to agree with Pappa G on this one the OP quite clearly subscribes to the urban myth that sitting in the car with the engine running is not parked, and this is just why landowners get persuaded to engage scumbag PPC's



    However no reason to not try your hand at POPLA!
  • Thank you for all your replys, I actually didn't realise I was there for that long, bearing in mind it was Xmas and the carpark is in town it took awhile to get in and since I didn't Park in a bay I thought it would be OK. So should I just pay the fine??

    the time for getting in and out is the grace period , as you did not take the offer to pay for parking the second grace period does not apply . therefore the only grace period is the entry one of 10 mins

    But the bottom line is, the £100 pseudo-penalty is even more unreasonable AND THAT IS WHY WE ARE HERE! :)

    Let's get this thread back on track before the OP thinks we are telling them to pay. We judge parking firms, not motorists (except real rogue idiots and this OP is not one). People dropping off or collecting their children after shopping with their grandparents at a busy site pre-Christmas retail location, are NOT fair game. How do we even know Smart have the timing right or how busy the car park was?

    We don't know if this was in Scotland or if they have a POPLA code. <<< edit, we do, so we help with POPLA stage like always!

  • Hi, it was in Stevenage matatan carpark and yes I have today received a code, I really don't mind paying a reasonable fine I just don't understand how they can justify the fine they ask for.

    Agreed but that does NOT feature in a POPLA appeal; justifying it carries no weight.

    So read the NEWBIES thread post #3 and go and get the POPLA template points. We assume you said who was driving (I hope not, though)?
