WWYD Solicitor exchanged on wrong house!!!!

I'm a little bit too annoyed to form decent arguments right now so I need help.

We are buying a house, due to exchange yesterday. Our vendors are selling two houses, mine (an empty rental with no chain), their house (house they live in, has a chain. that is not yet complete). Same solicitor dealing with both house sales, has been relatively useless throughout but today she's taken the biscuit. Yesterday she exchanged on the WRONG HOUSE!!!! So on Wednesday, when we were supposed to be completing, they are going to be homeless and have said that they are now going to move into the house (not even in the same city as the other house) we are buying until their chain is complete. Having not exchanged yet due to their tool of a solicitor I know that legally we can't do much. How do you suggest I hit the fan?

Our situation is that we will be homeless too on the 31st of this month (currently in rented) but we haven't booked any movers because we aren't moving far and were going to do it gradually after decorating. Personally I think that their solicitor should be paying for somewhere for them to live in the meantime instead of mucking up our house purchase. Any suggestions?

    I'm slightly confused. Are you using the same solicitor as your vendor?

    If you are renting why will you be homeless come 1st February?
  • I suggest you explain to your solicitor how important this is, and get them to apply as much pressure as possible. That is what you're paying them for!

    We have already given our notice in because contracts were signed and we were ready with no chain.

    Sorry just to clarify as I'm not sure this makes sense:

    House #1 - currently empty; you are due to buy this but haven't yet exchanged contracts

    House #2 - currently lived in by vendor; selling to a third party; meant to exchange, but contract listed house #1 instead

    If no transaction has completed (i.e., no exchange of contracts) on house #2, why is the vendor homeless?

    In any case, if you haven't exchanged contracts, there isn't much you can do other than threaten to pull out.

    Maybe I'm missing something..

    If no transaction has completed on house #2, why is the vendor homeless? His buyer moving into his house when he has no house to move into, apart from a 'convenient' rental property in a different city that has not yet exchanged due to an error,

    If you haven't exchanged contracts, there isn't much you can do other than threaten to pull out.

    No, we signed the contract on our house, it just hasn't exchanged as planned as the vendor has decided to move into it for x amount of time until the chain on the house he currently lives in completes. The vendor's other house sales/purchases had nothing to do with us until today.

    Personally I can't see how this would happen - the solicitor for the third party would surely question why they are exchanging contracts early if they were not due to do this. This must have been deliberate.

    Could it be that the vendor is having problems with the house they are purchasing, and need an excuse to move into the empty property?

    I believe the buyers of house 2 were ready and therefore didn't question it. The onward purchase is not ready.
