I really need advice---please help save my sanity---am so overwhelmed with information…
I so wish I was aware of POFA & all this amazing guidance before but alas (!)….
Private parking company (IPC member) have charged £100 (£60 payable if within 14 days & discount deadline expires next week—feeling quite pressed about that) & I’ve unwittingly admitted I was driver of alleged less-than-60-seconds incident….
Of course, they’ve rejected my (internal) appeal that I WAS NOT PARKED by their definition “stopped vehicle & left for a period of time” –as I had never left the car.
Is there some hope of a successful appeal on the technicality side? I have noticed time of charged incident in main body text of NTK letter is incorrect by a few minutes from their time-stamp “evidence” photo facility online.
I have mentioned it to the PPC but no response from them---surely I’ve not “exhausted” the internal appeal process already?!
I have also since further noticed that the timestamp on the photos of my car in first NTK letter are in fact illegible/blurred….isn’t this a breach of their IPC’s Code of Conduct?
Reluctant to engage with Independent Appeals Service as I’ve little time &/energy….but what to do now? Is there anyone that can help with IPC appeals & legal advice? Quite frightened at the thought of “Going to Court”…. can’t Citizen’s Advice Bureau help with the legal side? …. :-/0 -

But I'm even more surprised now that I've found another thread re. PCM/High Point Village Hayes-Ballymores, etc as that is EXACTLY where PPC have issued me said PCN for so-called parking!!0 -

I am a newbie on this forum. I only found this forum because I put some search terms on google and this came up. I really need your help. After reading this newbie thread, I realise, I made a mistake. I got a parking charge notice from ParkingEye asking me to pay £100 for parking in front of a hotel even if I displayed my disabled badge. The charge will potentially rise to £300. I don't want to out myself so I'm trying to keep it vague.
I got this notice on my birthday and it spoilt the whole celebration for me because I've got a long term illness which would have killed me twice so we were supposed to be celebrating me, still being alive.
Unfortunately, Timothea, I admitted on the online appeal to the first notice that I was the driver. This is unlikely me because I would normally research before replying to any of these but I'm going through a difficult period with my illness and i just wanted to get it out of the way. I have since received a reply to my appeal that it's been rejected as well as subtlety threatened by ParkingEye that if I appeal to POPLA, I will have to pay the full amount. They have given me a POPLA reference though but I need your help now because I have genuine reasons for being at the hotel that day although I didn't buy anything.

For those requesting Keeper details from DVLA using the V888/3 form there is a requirement to wait 29 days from the "incident" before requesting the data. Does this apply to PPCs who use KADOE to request/ access Keeper data?

I received an ANPR PCN from a Private Land Owner for a brief stop (6 minutes) as I had a fault on my dashboard (Hazard light). I wrote informing them that I had a fault and was not parked but briefly stopped and that I had not left my vehicle. I also stated that I would not be paying the £100 fine. They responded yesterday rebuking my claims. My question is that after reading Timothea's informative post could I possibly use the attached too? All advice very gratefully received indeed
The driver did not "park" (stopping briefly is not parking) and could not have entered into any contract because a contract cannot be forbidding and, in any case, the driver had no chance to read and accept the terms of any contract before the alleged contravention occurred. Furthermore, you cannot use Section 4 of the Protection of Freedoms Act 2012 to transfer liability to the registered keeper because the location of the alleged contravention is subject to statutory control, and I am under no obligation to name the driver.0
