The car is Alfa Mito.
The car finance people have basically come back and said your double ducked. I dont really know what to do now as im faced with.
1. Letting it be repossesed and if i di this, id faced issues as Im about to buy a house:|
2. Paying at least 4500 to have it repaired at the dealer
3. Settling the car amount of 5100
4. Part ex for a maxnum but doubtful £750 by the dealer.
5. Mot runs out Sunday and tax end of the month - if I dont MOT and tax it, im liable for the full cost as this is breach of my car finance.
I was tempted to contact DVLA, revoke the myself being keeper and leaving car where it is for the finance company to sort out...but apparently that will be abandoment and ill be liable for the cost of the car by the finance company.
They have also said I half own the car.....but in my contract it says im only legal owner once ive paid full amount...............
Its pretty comical really:| if it were not so frustrating...........0 -
The other choice I thought i had was my GAP insurance, (the car would be a write off due to cost) but I understand that usually insurance wont do this for engine failure...unless involved in a accident, arson etc0

You need to quickly get yourself (re)acquainted with your responsibilities here before this causes you a far bigger issue than the value of the car
In order to help
Which model of Mito - presumably a diesel if you're talking DPF
Was it bought from within Alfa dealer network under their warranty/finance and with full service history
If not where bought/who provided finance/warranty
(Some) Alfa dealers far exceed their responsibilities to maintain brand loyalty - which one are you using ? There are also some very good independents/specialists depending on where in the country you are - look at www.alfaowner.com for more details
In summary though this is your responsibility on a 5+ year old car and you're not going to be able to walk away from it. The Tax/MOT situation is going to need some explanation to finance co but I don't expect this is a major issue - may just need SORN until sorted0 -
Morning K3lvc
The car is a 1.3 diesel engine JTDM2, and was bought from a non-alfa dealer.
Ive actually ended up settling the cost of the car with the finance company and will now be the proud owner of a car without an engine:)
Ill have to declare the Car off-road and then look at problaly selling the car as is. Im out of pocket a lot but at least no recurring debt hanging over me and will keep my credit history clear of CCJS and never ever have car on finance again.
my main query now - the warranty
Speaking further with the dealer to see about the cost of a DPF (as i assumed that would nee replacing with the engine). There is no actual fault with the DPF. The engine oil was excessively High and this is caused by the DPF......... and im going round in circles as they refuse to honor the warranty.
I understand the DPF to a point. It gets blocked, a light comes on, your advised to "keep driving" by the handbook (and previous advice has been to do a long journey) which then clears it..........The DPF light hadnt been on around the time of the failure.............so what I meant to do? If the light hasnt been on, no engine warning lights...........then sureley there could be a problem with the ECU......Id expect something, the car into limp mode sound different etc but nothing........
Someone suggested to me getting an independant report, but ive been told the warranty place will only deal with the dealer. Hence I think and guess now, get rid of the car and take leagl advice over being misold about the warranty0 -
A wise move paying off the finance but given it's all outside of the dealer network then not much more I can offer - you're at the will of an independent dealer and a 3rd party warranty company
As before look on the Alfa Forum - they're a helpful bunch of people0 -
Op - what aspect of the warranty was miss sold?0

K3lvc - apologies I may have confused things. Ive been so annoyed and worried about things I may been just keyboard bashing. i feel clearer now Ive cleared the debt:)
The extended Warranty, GAP insurance, Finance and car have all come through the same dealer. A big dealer franchise as well, it just wasnt Alfa.
Ive been on some of the Alfa forums and a couple of people have indicated that im having the wool pulled over my eyes a bit and maybe should get an indepedant engineer to view the car..........
Wgl2014 - The main issue for me on the missold was that the intiial documentation (which was very very brief) was given includes generic terms like "diesel components" "engine" "exhuast components".
I had never even heard of a DPF until I had this car a while, but again the part is specific to diesel....and id expect now it to be covered under this, or under the exahust components.
I have eventually managed to get the full documentation - oops i tell a fib. once the claimed had been rejected, I was only issued 4 pages from the full documentation..........having a clearer mind now, ive reread this and its really contradictory.
At the time I had taken the highest warranty I could and in this the top packages says that "cracks and failure to head cylinders and valves due to carbon build up are not covered" - which is guess where they are comming from.
but in the lesser policy, these are covered and the above statement does not exist...............its almost like have the premium warranty actually defuncts the lesser policy, even though its included. Also says in the policy that consumable items such as filters etc are covered under the same lesser warranty and other things like fuel system cooling system. I guess its in the wording and maybe im not asking the right questions.....
I just dont get it all to be honest. If ive had nothing to indicate my engine was about to implode, melt my fuel injectors etc and never work again..............then surely something has failed and saying the car is all working as intended, but your oil is really due to no fault of anything just seems like a get out.... if it had failed next month. i would have cried, cut my losses and settled the payment. But it hasnt, its failed when in warranty and any engine failure, i was lead to believe was covered,,,,
Strangely the initial issue that they thought it was and so did the first garage was the timing..which is covered:) but the DPf isnt apparently sooooo
....I think i need to take further advice and possibly speak face to face with the dealership manager and get my own engineer....
thanks all:)0 -

If you want to get anywhere, having a coherent story might help.0 -
Even if the warranty doesn't cover it, surely SOGA will require the dealer to contribute to the repair cost. An engine should last longer than this.0

Buy an engine of eBay £1200?
Plus dpf plus fitting and consumables... eek not saving you much0
